The subject from whom the sample was taken still should have been informed of this fact and given her consent, but keeping this act confidential does make it better.

To explain is it acceptable that given complete confidentiality and the fact that using the sample can’t physically harm the patient.

This is acceptable since the patient is informed and the sample will be kept confidential.
