November 3 brings another election day that lacks the big attention of a presidential voting, but is important for all Pennsylvanians. The race in the Supreme Court of Pennsylvania will be watched closely because it’s the highest court in Pennsylvania and the small Republican-held majority may be taken away.
Death sentences, reversing sentences and hearing lower court’s cases are parts of the job requirement as a justice of the Supreme Court. Currently the 5-judge court has a 3-2 Republican

A “recommended” approval was defined as a candidate that would be able to “satisfactorily” perform as a judge or justice. The Bar Association defines its “not recommended” reasoning as a candidate, based on legal ability, experience or integrity being inadequate in performing satisfactory work in the courts.

Bailey, Kamoie, and Maltzma’s article answers the question to whether Solicitors General (S.G.) influence Supreme Court justices to behave differently than they would like. The article argues that unlike some studies that assert that S.G.’s influence the justices decisions, the reality is somewhat contradictory. They claim that Justices are more sympathetic to motions from the S.G. when both the justice and S.G. are “ideologically proximate” or when the Solicitors General’s motion is conflicting to his own ideological tendency. According to them, “justices will find a solicitor general’s information more credible when the solicitor general and the justice are ideologically congruent or when the signal from the S.G. is ideologically counter to his typical policy views”. (p 72) That means justices are sympathetic to the SG’s signals under two circumstances: when their ideology is close to the S.G.’s ideology or when the S.G. files a motion that opposes his own ideological tendency.
A crucial argument left unanswered is if state judges should be appointed or elected? Conflicting views raise many questions about how things would change in the court system. According to the article Justice at Stake, “One of the hottest debates in judicial politics today is whether judges should be chosen through competitive election or appointments. Each side has pros and cons”. Many states elect their judges through a merit selection process or appoint them through a process called the partisan election. Texas judges use partisan election where judges are elected by the people. Another question that arises is if Texas should continue using the partisan election to elect their judges when it may seem untrustworthy. A decision could be discussed on the process in electing state judges such as on the topics of improvements, conflictions, and which process seems more reasonable. Improvements can be made to the process of electing state judges… Overall, the appointment of judges varies by state, but looking at Texas’ past and present justice system will determine whether Texas should continue to elect, or switch over to appoint.

The appointment and confirmation of Justices to the Supreme Court of the United States involves several steps set forth by the United States Constitution, which have been further refined and developed by decades of tradition (Supreme Court, 2011). With the current presidential elections approaching soon, there is plenty of political activity going on in our communities. Many people follow the presidential elections and listen to what these candidates have to say, however, there are other elections going on in our own communities that also have a big impact on us. We sometimes tend to forget about our local candidates and at times ignore what they have to offer for us. I, myself, am able to relate to this. I decided to take action and go out to a local community to do voter registration with the hope that people would not only register, but also go out on November 8 and vote.
