On 09/12/2016, Johnathon Lussier contacted the Pasco Sheriff`s Office by telephone to report a delayed vehicle burglary and grand theft. Mr. Lussier advised sometime between 2345 hours on 09/10/2016, and 0015 hours on 09/11/2016, an unknown suspect reached into his open body style ATV and stole his Beretta 9mm firearm out of the glove compartment while the ATV was left unattended at the noted location. Mr. Lussier stated he went to assist another mud bogger whose ATV had gotten stuck in the mud. He left his ATV unattened for approximately thirty minutes. On 12/17/15, a report was made with PCSO at 9524 Bamboo Ln. Jacksonville, AR in reference to a Commercial Burglary at Grindley Pools. Investigators responded to the scene and processed the scene. Inv. Reyer made contact with Mr. Jason Morgan a manager for Grindley Pools, who stated that during the theft a 2002 white chevy pickup (VIN# 1GCH29172E2466246) was taken.

Assist West Mahanoy Twp. with a report of an armed subject at Hollander Home Fashion. Individuals on scene reported a hispanic male walking in the parking lot with a hand gun in his hand. One male said after seeing the male with a gun he asked him what he was doing with a gun, but then continued walking toward his vehicle and never looked back to see where he went. Another male said he saw the guy walking from the building toward the parking lot and the hispanic male then whistled and got into a black shinny Hummer and left the area. There was no clothing description of description of the driver of license plate.

On 10/23/17 Det. Coleman and I went to Belk`s to speak the reporting person, Jerome Stover. I asked with Mr. Stover if he was familiar with a previous larceny with similar circumstance`s (2017-01479). Stover was familiar with the larceny but stated that these were separate individuals. The suspects in this case did get into a vehicle fitting the same description as the above listed OCA as well as similar property taken. After speaking with Mr. Stover, Det. Coleman and I went to Food Lion to attempt to locate a vehicle fitting the suspect vehicle description on their video surveillance. John Kremer. Met with John from the McCamry (SP?) County conservation district. Met him at an event they had at their office. He came in we did a no obligation appointment, data gathering, and this meeting was for the plan delivery. We went ahead and went through the retirement timelines. Showed John the different ways that he could retire at different ages. The ability to retire at age 60, 62, what the difference would be if he took his retirement pension from the conservation district at 60, 62, and also what it would look like if he took social security at 62, 67, and then also showed him what he actually spends on an annual basis. I arrived on scene with fellow officers Stark and Withrow who were already with the victim. I was informed the vehicle involved is a blue Buick Park Avenue, approx. 2001 model year. After checking the immediate area, I requested information on where the suspect resides and was told 1740 Blackhawk St., unit 104.

Arthur said the female was there to survey his home and collect water samples from the home. Arthur said the female had him get water samples from around the home. Arthur said while he was collecting the water samples the female went into his room and stole a Smith & Wesson .357 caliber pistol
After a checked of the stolen vehicle, Officer Vojir located a hand gun on the passenger side front seat. The firearm had no associated record.
Erik Ayala had purchased the murder weapon, a 9-milimeter pistol, from 99 Pawn & Guns on January 9, 2009 (ER 3, Memo in Opp, Ex. D, Depo of David Kartchner, 45:13 to 47:18; ER 42-46, Exhibit 1 attached to Kartchner Affidavit). The 99 Pawn & Guns employee that sold Erik Ayala was David Kartchner (Memo in Opp, Ex. D, Depo of David Kartchner, 45:13 to 47:18; ER 41-46. Memo in Opp, Ex. G. BATF Form 4473). When Mr. Kartchner submitted a background check to the Oregon State Police for approval, the Oregon State Police issued a two-day hold on the purchase (ER 45-48). Despite the two-day hold order by the Oregon State Police, Mr. Kartchner did not delay the sale and sold the gun to Erik Ayala on January 9, 2009 (ER 47).
