Due Process Model Vs Crime Control Model

On April 15, 2013 during the Boston Marathon in Copley Square, two bombs exploded near the finish line killing at least three and injuring over 170 people. This bombing sent the nation in an uproar and it was immediately recognized as a terrorist attack. When the Federal Bureau of Investigation took over, a few days later a surveillance video and photographs of the two suspects were released.

These two models symbolize a trial to conceptualize two different value bases that contend for precedence in the functioning of the criminal course. This is an aspect that points to there being a number of widespread differences between the two models that shall be explained. A case in point is that while crime control model seeks to offer effectual crime control, the goal of the due process model is to actually offer due justice.

On April 19, 1995, a detrimental explosion targeting the nine-story Alfred P. Murrah Federal Building in downtown Oklahoma City, Oklahoma took place. This incident of domestic terrorism and the mastermind behind the explosion was credited to Timothy McVeigh who used a truck-bomb to kill 168 people and injure countless others (History.com Staff, 2009).

Within seconds of the clock striking 2:49 p.m, a bomb goes off in front of Marathon Sports store near the finish line of the Boston Marathon, killing one and wounding a number of others, both runners and spectators. Less than a minute later, another bomb lets off in front of the Forum restaurant, killing two more and injuring many more(CNN). As chaos began to erupt, Boston PD sprang into action immediately. Citizens expect results, and want to feel safe when they are in their own neighborhood. This event happened on April 15, 2013 in Boston Massachusetts. Two brothers by the names of Dzhokhar and Tamerlan Tsarnaev decided to place two pressure cooker bombs amidst the crowd of marathon runners. Only two seconds apart, the two bombs went off along the finish line on Boylston Street. Leading up to the event there was the conflict in the middle east, which is where both the brothers were born, and they wanted a way to get back at the United States. The criminal justice system in the United States has traditionally operated under two fundamentally different theories. One theory is the Crime Control Model. This theory is characterized by the idea that criminals should be aggressively pursued and crimes aggressively punished. The other theory is the Due Process Model. This theory is characterized by the idea that the rights of the accused need to be carefully protected in any criminal justice investigation. (Levy, 1999)

This paper will explore events surrounding the Boston Marathon bombing incident and evaluate the effects caused by the incident. A conspiracy theory is a theory that argues that the rich and those with power seek the make sure the criminal justice system fails because they benefit from that failure. Conspiracy theories are hard to be proven and for it to succeed, it has to be kept a secret. There’s no credibility in the sources due to the degree of secrecy. Conspiracy theories are invalid because it doesn’t correspond with how people behave most of the time. The Pyrrhic defeat theory isn’t a conspiracy theory because the theory bases itself on why the criminal justice system fails and that’s due to our own shortcoming of not trying hard enough to prevent it.

The only similarity between Due Process and Crime Control Model is that they both relate to the framework of the United States Constitution. They both embrace Constitutional work and values relating to our adversarial system. Both models make it known that law enforcement including prosecutors and police are not allowed to act against a person unless there is some probable cause and evidence that illustrates that they violated the law.

The Crime Control Model and the Due Process Model are very important parts of our criminal justice system. Without both of these models in our system it throws things off balance and causes a lot of problems. Over the past many years our Criminal Justice System has changed and with these changes we have found better ways of keeping our system balanced. In order for our system to continue to stay in balance then the Crime Control Model and Due Process Model need to be used together.
