A. Requirements The state of Maryland has special requirements to identify and classify students who qualify for EL services. Parents are asked to complete a home language survey upon enrolling their child in school. Local education agencies look at the survey to see who may be eligible for EL services. In order to be eligible for EL services, one must speak another language other than English and/or come from a home whose primary language is not English. Students who speak another language other than English may be eligible for services, however language alone does not qualify the student. Possible candidates must take the English Language Proficiency Test to see if they qualify for services. The state of Maryland uses WIDA to assess English language proficiency levels. The test is given within the first 30 days of school or within the first 2 weeks of being a “new” student. The results of the English Language Proficiency Test will be used to determine if the student qualifies for services. National requirements do not require states to administer a particular proficiency test. The state is able to choose the assessment of their choice. The WIDA screener is released in August and should be given within the first 30 days of a student being new, however National Requirements do not specify a time frame for the assessment. A parent notification letter is sent home if a student qualifies for ESOL services. This letter is sent home every year to notify parents of eligibility. The letter indicates the child’s English proficiency level and method of instruction. The description of program placement options and goals are also included. Parental rights are stated at the bottom of the letter. Some ELs may no longer eligible for ESOL services if his or her WIDA scores are met. If a student no longer qualifies for EL services, he or she will be observed for 2 years. “ ELs who no longer require Title III services and who are exited from English language development services are monitored for two years to ensure that these students continue to make progress in meeting challenging State academic content and student academic achievement standards.” (Maryland Department of Education, 2023) If a student is not making
adequate progress, he or she will be reevaluated for services. B. Table State Requirements Three Procedures Teachers Need to Follow Three Instruments Home Language Survey given upon enrollment. WIDA Screener given within the first 30 days. The ACCESS is given to determine English language proficiency levels. Home Language Survey must be completed by parents within the first 30 days. Parent notification letter must be sent home to notify parents of eligibility. Students are given an assessment once a year to see if they are eligible for services and to measure progress. Home Language Survey WIDA Screener ACCESS C. Family Role and Rights Families must complete must complete the home language survey to help local education agencies identify possible EL candidates. Parents may request a translator if they are having trouble completing the survey due to language, however the survey is always translated in the families native language. Translators can ensure that the information provided by the parents is precise. Once a parent has completed a home language survey, he or she will receive a parent notification letter stating whether or not the child is eligible for ESOL services. The language instructional education program will be described in the letter. Parents can request a different method of instruction if they do not agree with the method that has been chosen. If

for any reason the parent does not want their child to receive services, he or she can refuse. Parents who do not wish for their student to receive services must contact their child’s ESOL teacher and fill out appropriate documentation denying services.
