Racial profiling is a law enforcement and security agency practice that encourages officers to stop, search, and investigate people based on race, ethnicity, nationality or religion. While racial profiling is most commonly committed against ethnic minorities, many instances of racial profiling occur in reaction to specific crimes, making any racial or cultural group subject to more intensive scrutiny by the authorities. (ebscohost.com) This is what I think bout racial profiling, it like it occurs when the police targets someone for investigation on the basis of that person's race, national origin, or ethnicity. Racism has been a big problem in the U.S. for all races for a very long time and continues to be a problem to this day,. Racism has been a big part in U.S. history and has changed over time, some of these races were African Americans, American Indians, and Mexican Americans, for American Indians it was how they were treated wrong socially and economically.

Racial profiling is still an ongoing issue that occurs and such an issue has led to many problems for the minority groups of this country. Whether it be African Americans, Indians, Asians, Mexicans, or Muslims, all have faced profiling at some point in time. The problems caused by this controversial subject include the impending distrust between black communities and law enforcement, unfair treatment towards all minorities by law enforcement, verbal and physical abuse of minorities by police officers which can sometimes lead to death, emotional unstableness of the victims whom have faced such a terrible judgement, and the negative impact it has on children of the minority groups.

Racial profiling is a very prevalent issue within the criminal justice system that is quite controversial, but there is a significant number of evidence that shows that racial profiling has been present since the 1600’s and continues to be a significant issue. Racial profiling is evident in the criminal justice system in various ways such as in interrogations, jury selection, misleading statistics, stops, and immigration laws. Racial profiling within interrogations and jury selection can be seen with the Brandley v. Keeshan case. Racial profiling within statistics can be seen in instances where the numbers focus on arrests and incarcerations that do not necessarily mean a crime was committed. Stops are seen as evidence showing racial profiling with a personal experience, and lastly, immigration laws are seen as showing racial profiling by the encounter of a Mexican American women had with an officer in Arizona.

Racial profiling is used by many Americans in the united states. Blacks, whites and mexicans all use racial profiling. Their profiling is much different then you could say is used by police enforcement today. Minorities are high on the list of racial profiling by police in today 's society. This has caused many issues with minorities and police enforcement relations since police use this as a way of controlling crime rates in many cities. With this paper it will be to show and scrutinize every aspect of consequences of racial profiling with police and individuals such as minorities. To be able to explain and probe racial profiling and the issues that coincide with this issue. I will then provide an explanation with background of what racial profiling means. Then providing research that will show the issue of racial profiling with how it will affect the relations between individuals and law enforcement departments.

“If someone puts their hands on you make sure they never put their hands on anybody else” (Malcolm X) is a contestable ideal. Do we Americans allow our law enforcement to continue killing innocent African Americans whose own ancestors contribute to the success of this nation? No! We cannot sit on the sidelines and watch innocent lives ruined over and over again. We must auscultate to the cries of our four fathers. In order to halt the self-destruction of this nation we should fight for change in the police force, attempt to cease the embodiment of racial profiling, and support the efforts of those striving to bring about change.

In the Justice System there are a lot of flaws that affect many people of color, and from past history, it has shown how these practices can lead to very unfortunate events, one of these practices is racial profiling. Racial profiling is when law enforcement uses race and ethnicity as grounds to determine if someone, typically of color, is guilty of doing something illegal. Racial profiling is a major problem in this country, this as well affects many citizens that are mainly of color because law enforcement usually sees them as targets, and it is important to improve and fixed this issue because there are many tragic incidents that have been caused of racial profiling.

Racial disparity in the Criminal Justice system has been a issue of discussion in our law enforcement for years. Statistics say the likelihood of imprisonment in a lifetime is 1 in 3 black men, 1 in 6 Latino men and 1 in 17 white men. (Bonczar2003) The search and seizure 4th amendment was passed in 1789 which was supposed to protect all persons of unreasonable searches, etc. In 1944 Gunner Myrdal wrote “it’s part of a policeman’s philosophy that Negro criminals or suspects that show any sign of insubordination should be punished bodily, to keep the negro in his place.” In the late 1960’s early 70’s there were many riot commissions that recommended changes in police practices, especially aggressive stop-and-risk procedures.(Skolnick1969) Racial disparities have been an issue for years, especially in traffic stops. There are a couple different approaches to help reduce or end racial profiling. The ACLU’s 5 part battle plan to end racial profiling (Harris2003), and The Racial Justice Improvement project (ABA2010). Racial profiling is an issue in many aspects of the Criminal Justice system. This paper will mainly be based on traffic stops and in sentencing.

Racial profiling in law enforcement is referenced when a law enforcement officer targets an individual for suspicion of a crime. A broader definition of racial profiling in law enforcements is when a law enforcement officer, uses an individual’s race or ethnicity, age , time of the day (usually later in the day), dress code and also location to accuse a person of a crime. In today’s world the term racial profiling can be viewed in various view points, because of people having different opinions on the term, many disagreements occur. Some people believe that specific incidents are not cases of racial profiling and others think otherwise, needless to say an argument occurs.

There are many types of racism in America that cause people to make accusations against law enforcement for discrimination. One type of racism is racial profiling. It is a strategy that encourages police officers to stop and question minorities only because of their race. It takes place in a variety of routine police encounters. Unmotivated searches occur everyday among the minority groups. Could you imagine waking up and being scared to walk outside your house because of the color of your skin? This is a fear of almost everyone belonging to a minority group. This continues to be a widespread problem throughout the country.

The most visible source in a racial profiling case is Title 42, U.S.C. section 1441 under the Crime Control Act of 1994 (Hemmens, 2014). Other sources such as the Fourth Amendment, and Fourteenth Amendment provides some relief in the issues of racial profiling, but Title 42 section 14141 is more effective. Title 42, section 14141 seek to end misconduct of law enforcement officers in their pattern and practice (Hemmens, 2014, p. 53).

Racism and racial stereotypes have existed throughout human history. The radical belief associated by thinking the skin color, language, or a person’s nationality is the reason that someone is one way or another has become extremely detrimental to society. Throughout human existence it has sparked tension between groups of people and ultimately influenced wars and even caused slavery. Racism in America dates back to when Native Americans were often attacked, relocated, and assimilated into European culture. Since then, racism within the states has grown to include various other cultures as well. In the essays by Brent Staples, Bharati Mukherjee, and Manuel Munoz, they discuss the various causes as well as the effects that racial stereotyping can place on a victim and the stigma it leaves behind for the society to witness.

Although people in the United States are entitled to privacy and freedom there is a limit to that privacy. State or federal officers are allowed where justified to search your car, house, property in order to seize illegal items such as drugs, illegal weapons, stolen goods just to name a few. When the police do searches it can be for various reasons it depends on the situation. They can have a search warrant to go into a premises and confiscate illegal paraphernalia or when doing a routine traffic stop an officer might become suspicious of activity that is not normal and conduct a search of the vehicle to see why the driver is not acting normal. Racial profiling has become a severe obstacle in the U.S. today though most Americans know very little of this vital issue. Every day, people are being pulled over, harassed, and even killed for being of a certain race. There are new laws that politicians are trying to pass that promote racial discrimination. Racial profiling is immoral and does not increase public safety.
