However, juveniles should be tried as adults because they committed a crime in which they must pay for which they also knew it is wrong. Cristian’s mother, Biannela Susana, had left him and his two year old half brother, David, home alone. In the article “Cristian Fernandez,13-year-old Fla. boy, faces life in prison for allegedly murdering his 2-year-old half-brother” by Crimesider Staff states, “the toddler had a fractured skull, bruising to his left eye and a bleeding brain”(Staff) which indicated that Cristian had harmed/ beated his baby brother. Cristian had a rough childhood. His mother was only 12 when she had him, his “grandmother was taking care of him was holded up with cocaine in a motel room”(Staff), he was beaten by his stepfather, and sexually assaulted by a cousin. So he didn't have anyone. He was alone in this big world with no one to protect him or look after him. It was inevitable for him to kill someone. Cristian should be charged as an adult since he did murder a two year old however, he was emotionally and physically hurt and abused which must have played a factor him to kill his brother. Derek was the one that killed the father in his sleep with a baseball bat then burned the house down while Alex gave the idea of killing their father to Derek and was with him the whole time but did not participate in the killing of their father. The reason why they killed their father was because they were being physically and mentally abused by him. They should have been charged as adults but not life in prison because they were being abused and they were tired of it and wanted it to end for good. Now many would argue and say “No they shouldn't be tried as adults their brains are not developed fully. They still do not know what they are doing”. Yes that is the case for some but not many nor this case. In chapter 5 and 6 both Derek and Alex “know right from wrong” and Derek has a “high IQ” which demonstrates that they both knew what they were doing to their father. Their brains were perfectly fine, they did not have a mental disability to argue for a smaller jail sentence but they did serve 8 to 9 years which was far. In regards to “They still don't know what they are doing” is not true because at a very young age children learn what they should and should not do. We learn that killing and stealing are very wrong and we should not do. So juveniles should be charged as adults.

Erik Jensen, 17, and Nathan Ybanez, 15, were sentenced to prison for life without parole. Nathan struck his mother with fireplace tongs; then he, Erik, and their friend, Brett Benson, destroyed the evidence. Brett took a plea bargain. Some say they deserve life because of their crime, but they were not in the right place of mind. Therefore, justice was not served in either case.

The brain is considered undeveloped until one is in their mid-20s. At the age of 13, youths are known to have an undeveloped sense of responsibility, and lack a great deal of maturity. Which causes them to have little control over their environment. The two girls at age 13 accused of attempting murder on a classmate show them to be two dangerous individuals. But, for them to plan this to impress a fictional internet character shows their decisions are made due to their immature psychological level of their age.

Widely perceived by people in America, many feel juveniles should be held accountable for their actions and be tried as adults. Other people feel strongly that given juveniles' age and ongoing brain development, they should be offered reasonable punishment instead of solely being tried as adults. Treating children as adults is simply unfair. Despite the adult nature of the crimes, juvenile criminals should be treated as minors in the criminal justice system because of the brain's inability to understand their actions because of existing brain development in comparison to adults, juveniles should instead be offered rehabilitation and resources.

The boy agrees and tells the police it was his fault and he is sent to adult prison for the maximum sentence. Children are both easily influenced and not as intelligent compared to an adult. First, Juveniles should be trialed because at any age people know what they are doing. They say that juveniles know what they are doing and should be held responsible for their own actions.
