Introduction The idea of probation refers to the release of an offender from detention based upon good behavior. Probation, itself, is the process in which offenders are monitored by officers in an attempt to correct their behavior and prevent further offenses. This process, however, is centered on the idea of changing cognitive processing toward crime, to implement operant conditioning and to manipulate social learning, all of this relating to a psychological lens. Using these separate techniques creates the overall idea of probation and is able to formulate the ways in which it works. In order to assess the idea of probation, an analysis of crime should be assessed as well. Criminal activity and the reasoning behind people committing crimes is correlated with functions and processes of the brain. The Amygdala assists in affecting fear, aggression and social interaction. The Amygdala is located within the temporal lobes of the brain and is considered part of the limbic system. The right Amygdala induces negative emotions, such as fear and sadness, where the left Amygdala induces either pleasant or unpleasant emotions (Hans J. Markowitsch). Also, the Anterior Cingulate Cortex (ACC) plays a role in behavior regulation and impulsivity. The ACC is located in the front of the Corpus Callosum, in the medial front lobe. Imprisonment is extremely expensive, often too harsh for both the offender and his/her family based on the crime committed, and tends to be far less effective than hoped in rehabilitating the offender. Probation is used far more frequently than imprisonment but is problematic because many repeat offenders have already unsuccessfully undergone prior probation and there is a lack of supervision due to the heavy caseloads of probation department caseworkers. There are several steps to the criminal justice system, one of them is Probation; a program where the offender’s freedom is limited; usually they have a curfew, and have limits on the things they do. Probations Officers are a huge factor in getting the juvenile offender back on the right track following their sentence. One of the problems with probation is that rather than helping the offenders, sometimes it can hurt them. Some scholars argue that the officers do not take the juveniles, specifically females, seriously when it comes to referring them to receive mental health treatment. In contrast, other scholars argue that Probation Officers are the key to connecting the offenders with mental health care. I will begin by talking about how the gender of the juvenile contributes to the unjust treatment of juveniles on probation, then I will talk about probation officers as “the problem,” and lastly I will talk about a solution. I will conclude by stating my research question and making some contributions as to what can be done to build a stronger relationship between the offenders and the probation officers.
As through research one can say that a considerable amount of individuals who were sentenced for crime did not serve prison terms. Probation gives criminals a suspended or a waive through prison sentence and instead they are sent to the probation department for controlled activities in the community. Examples could include; education, work, restitution, therapy. The probation officer will have prepared a presentence investigation or presentence report. The PSI and the PSR gives a brief description of the individual’s criminal and noncriminal profile. These reports basically decide whether probation should be given or not. If probation is recommended a course of activities and restrictions for the probationer would be specified. The circumstances may be rigorous, for example; house arrest, electronic surveillance, curfews, no meetings with former friends. On the other hand, they could also be less stringent, for instance; attending school or a treatment program, not drinking spirits, and making monthly visits to the probation officer. Probation serves as the most frequently used sentence for those convicted. This is evident when you consider that the United States justice system oversees nearly 7 million people. Over half of those, a staggering 3.7 million people, are on probation with another 840,000 on parole (Rabuy, 2017). With those individuals representing the largest percentage of the American corrections system, it is important that we learn as much as possible about probation in order to improve the success of these programs. Both jail and prison offer some type of early released programs, in this case probation and parole will briefly be discussed. Probation is a prison sentence that is suspended on the condition that the offender follow certain prescribed rules and commit no further crime (Seiter, 2008). Parole is similar to probation except that it is after a period of incarceration, which involved determinate and indeterminate sentencing (Seiter, 2008). The other types of prison sentencing include mandatory minimums, three-strike laws, and truth-in-sentencing (Wilson, 2001). The only difference is that a parole board allows convicts to serve the remainder of their term in society under supervision and strict limitations (Wilson, 2001). In summary both jails and prisons should strive to provide as much educational, health, and counseling opportunities as possible to reduce the likelihood of recidivism. These set roles the offender may face are things such as random drug testing and some form of rehabilitation. This gives offenders a second chance to rehabilitate them self and fallow the law.

A crucial part of the criminal justice system includes probation. Probation is the release of a criminal offender from detention or incarceration. At this time, the offender is subject to a period of good behavior under supervision. Probation is also referred to a kind of punishment that is giving as part of sentencing. Instead of giving an offender a longer sentence, a judge will order the defendant to report to their assigned probation officer on a regular basis, where the offender will receive a schedule instructing him or her of their probation requirements. If the defendant does not obey a probation order, the defendant will automatically return to jail or to court, only to be given a longer sentence by the judge. A person on probation is not allowed to leave the judicial district without permission of the probation officer or court (Seiter, 2011). The probationer shall report to the probation officer as directed and shall submit truthful and complete reports (Seiter, 2011). A person on probation must also follow all directions instructed by his or her probation officer truthfully. When on probation, an offender must obtain employment and needs to notify his or her probation officer of all changes of address within a three-day limit. The core components revealed in this course are definitions of crime in nature as harm causing behavior, the descriptions and classifications of criminals, the analysis of crime, profiles of everyday victims and offenses, and the origin of crime. The field of probation relies heavily on these components in order to understand and properly categorize offenders, stay aware of offender's mental and emotional status, and attempt to predict the future of criminal offenders. The various theories presented in Criminology 262 help shape the Dallas County Adult Probation Department and serve as model types used to minimize the risks associated with sentencing alternatives. The agency assesses the same theoretical categories provided by Criminology 262 such as sociological, biological, and psychological explanations of crime in an attempt to better deal with offenders. The internship experience has supported the previous notion installed through Criminology 262 that one single theory cannot explain crime. The combination of each theory and perspective enabled an opinion of individuality to form. In opposition to the core components embedded in the course, the personally constructed opinion that criminal offenders cannot be categorized and must exist on individual levels was formed from the internship experience. Actus Reus, Mens Rea, Causation and Punishment are all considered elements of a crime. Actus reus or also known as the “Guilty act“, is the external physical part of a crime. In other words actus rea “refers to intentional criminal conduct or criminal negligence“ (Powerpoint). It is not only about what a person does but also about what they do not do. It is committing a voluntary act which ultimately causes harm to others.
