Although it remains illegal for these corporations to directly donate large sums of money to political campaigns and political parties, the fear that political and judicial figures in the American political systems are being bought out by these affluent corporations still worries an inordinate amount of people in the United States. In this fast paced economy lay people are more concerned about daily errands and responsibilities than doing independent research about candidates. Most of people’s knowledge about candidates comes from television and radio broadcasts as well as the Internet. Further, as with any other major event in the United States, many people follow developments in the election trail more closely toward the end of it. Therefore, even if the Supreme Court did not technically allow the wealthy to spend more money on elections, it certainly created an incentive to do so. This incentive is the opportunity to reach the electorate during a time in which they pay more attention to radio, television and Internet election

Luckily, the dramatic change for finance laws came in the 1970s when the Federal Election Campaign Act was passed. This act paved the way for regulations regarding contribution limits. Before this act was put in place congress never took reports of the money being spent during the election. Finally, in 1967, Congress began collecting and analyzing the financial reports for campaigning. As according to Elizabeth Hanes on History.com, the Federal Election Campaign Act passed in 1971 established “fundamental changes” in campaign finance laws. Hanes goes on to state that in order for the Act to running smoothly the Federal Election Commision was created to “enforce” the campaign finance laws put into place. The Federal Election Campaign Act required full reports of all contributions, amount of money spent and limited spending on media advertisements. Years later in 2002, the Bipartisan Campaign Reform Act was passed, which limited the use of “soft money”, money raised by national parties and political action committees. Limiting this ability would benefit the candidates that are not strong in gathering donations. This is solely based on the communicating and networking factor of candidates. Reducing the power of candidates would allow the media to have a greater impact on the public donations (Esenberg, 2010). The small donors in the public are the ideologically committed union members, which are currently having their influence felt through the donations of larger corporations and Political Action Committees, debates Esenberg (Esenberg, 2010). Incumbents are also the ones who create the campaign finance rules that govern the process, so he foresees the unlikelihood of incumbents being willing to set rules that will make it harder to retain their seats (Esenberg, 2010).

Immigrants and youth who can’t vote are still impacted by the decisions of those being elected. Elections are paramount to our system of governance, however the way campaigns are run, and how funds are raised lack any meaningful oversight. The united states campaign finance system is in need reform, due to increasing deregulation, poor voter participation, and drastic increases third party spending. The root cause of this issue is our deregulated campaign finance system.

An assumption of representation is elected representatives are agents who express district preferences in legislative activities. Voters have preferences, but do not know which candidate in the election best align with these preferences; therefore, campaign communication and advertisements are important avenues that help highlight congruency of preferences between a candidate’s and voter’s positions (Krupnikov, 2011). This new electoral environment after Citizens United now has more independent campaign expenditures going toward election communications on behalf of candidates than in previous elections (Federal Election Commission, 2015). This new environment involves three primary entities for outside independent expenditures, Super PACs, traditional Political Action Committees, and political parties.

Donors of campaign money are one of the largest aspects of an election. In almost all elections the candidates relied on the money that comes in from donors to fund their campaign. In 2012, Democrat Barack Obama and Republican Mitt Romney raised about a billion dollars each during the presidential campaign. Obama raised more money from donors giving $200 or less whereas Romney raised more money from donors giving $2000 or more. The individuals who contributed to this were allowed to give up to $2500. Although Obama had more donations coming in from donors giving $200 or less, he still had many large contributions help fund his campaign. Out of Obama’s top five contributors in 2012, three of them were still his top givers in his 2012 election. Under FECA, the Federal Election Commission (FEC) was established in order to enforce the laws dictated within this legislation (Federal Election Commission 2015). This organization was created as a means of checking monetary contributions: it monitors soft money contributions, sources of donation, and audits publicly funded committees (Beneson and Tarr 2012). This commission serves an essential purpose of checking campaign finances and prevents mass corruption within campaigns. At the federal level, campaign finance law is enacted by Congress and enforced by the Federal Election Commission (FEC), an independent federal agency. Although more campaign spending is privately financed, public financing is available for qualifying candidates for President of the United States during both the primaries and the general election. Eligibility requirements must be fulfilled to qualify for a government subsidy, and those that do accept government funding are usually subject to spending limits on money.

The idea behind fundraising for elections was a success at first, giving donors another way to voice their opinions and open up the doors for communication once the elected officials fully realized who they owed their position to. However, this went too far. Those whose candidate did not win were left with an official who will accept the ideas of a past donor before any others. This favoritism, while beneficial to certain donors, proves damaging to others.
