On May 16, 2017, Agent Kelly Birch (Birch) conducted an interview of Frances “Eli” Smith-Lewis (Smith-Lewis) concerning the possible abuse of Shirley Rogers (Rogers). This interview was conducted at the Office of the Oklahoma Attorney General, located at 15 West 6th St, Suite 1000, Tulsa, OK 74119. Smith-Lewis was scheduled for an interview at 10:00am on May 16, 2017. At approximately 10:45 Smith-Lewis called Birch and stated he was here but was waiting on his attorney to show up. Birch went to the lobby to meet with Smith-Lewis and he stated his attorney could not find a place to park and ended up leaving. When he showed the video to Diamanochie, Diamanochie said “I don’t care I want to see her get off” and then started laughing. Thomas responded, “I’ll just watch her throw her hands up and say Hallelujah”. Smith-Lewis notified Lori Badley-Garrison, Rosetta “last name unknown”, and Patricia Evertt of Rogers behavioral changes and only showed the video to Thomas and Diamanochie. At this point in the interview, Birch asked Smith-Lewis if he would write a sworn statement, Smith-Lewis agreed to do so. At the completion of Smith-Lewis’s written statement Birch notified him that his cell phone would seized. Smith-Lewis the read the consent to search form, Birch then explained the consent form to Smith-Lewis. Smith-Lewis stated at the end of the interview that there was other photographs of residents on his phone that were taken at the Christmas party. Smith-Lewis took these photographs at the request of his boss for work related purposes. Smith-Lewis then stated that he did not want to lie to me. He stated that he did send the video to Chelsey Moss via text, but could not recall if she responded to his
