These are complex questions about who has property rights in the picture of Tiger Woods. Let's first start with the individual contract Tiger Woods and General Mills has. If Tiger Woods and General Mills agree that General Mills has complete property rights of the picture, then General Mills, for the most part has complete rights as negotiated by the contract between the two parties. Any violation from this contract would be a breach of contract and could lead Tiger Woods to sue General Mills. An example would be General Mills posting the picture in a negative way that could be perceived as a defamation of character by Tiger Woods.
The second approach to copyright is the democratic approach. All works of art are ideas built on a foundation of other ideas. The democratic approach advocates that intellectual property belongs to the society and should be available for the general good of the public. If the particular usage is intended to derive financial benefit or any other business-related benefits, it is considered inappropriate usage. If the utilization of factual work were more usable than the use of someone’s creative work, then that would not be fair use. There is no specified edge to the amount of quoted work that can be called “fair use.” The courts exercise common sense to determine if it was too much. If the utilization of the material created market or stirred a competition, and if the fair use diminishes demand for the original product, it is not considered as appropriate use (Crews, 1993).
Jonathan Allen Lethem, a modern American essayists, writes the article in which he talks about how some artists see plagiarism as a wrong doing or stealing. Lethem disagrees with those artists’ point of view. He writes, “most artists are converted to art by art itself. Finding one’s voice isn’t just an emptying and purifying oneself of the words of others but an adopting and embracing of filiations, communities, and discourses” (Lethem 87). This means that there is an inspiration behind every artist’s work. The inspiration could come from something as simple as expanding another artists’ works. It is normal for an artist to be inspired by other artists, and then invents a work of art that is similar to his/her inspiration. For instance, Lethem gives an example of how South Park, the TV show, was inspired by Rankin/Bass and Charlie Brown Christmas specials. Most of the time, plagiarism could lead to a great work of creativity.

Cultural appropriation is when someone adopts aspects of a culture that’s not their own. That's only the icing on the cake. It’s particularly a power dynamic in which members of a dominant culture take elements from a culture of people who have been systematically oppressed by that dominant group. What is cultural appropriation? It’s a term that has been used a lot in the past few years but also not enough.
