Labor Unions have declined in popularity as measured by the percentage of workers who are members, and that is attributable to several factors. Individual states have the right to establish their own minimum wages. However, employers are subject to the Fair Labor Standards Act and must pay the current federal minimum wages of $7.25/hour for non-exempt and $35,568/year for exempt or more. States have the right to require employers to pay higher rates than federal minimum wages, should the state so vote.
