The issue about finding balance between the state and the victims can be quite difficult due to the fact that the victim and state both want to find justice. First of all the state is going to want a punishment that is suitable for society however sometimes that is not enough for the victim or the victim's family. Working in the criminal justice system I have
first hand knowledge about how negotiations are handled and half of the time the charges are either dropped or reduced. Which is unfair to the victims and/or the victims families. In order to be able to create a balance between the state and the victim the should focus more on the offender's criminal history to be able to provide a plea that would be fair to both the victim and society. As such the state has created laws to help provide a balance between what the state is fair for the offender based on the crime and
the victim. As explained in the readings, Crime Victims: An Introduction to Victimology, "Each law that prohibits a certain act as being harmful defines the wrongdoer as a criminal subject to punishment and at the same time specifies that the injured party is a victim deserving some sort of redress." (Cengage, 42). With a balance in place the victim and/or the victim's family will be provided with justice and as such they can feel like they have made a change for future victims. For example, Kari's Law was enacted into federal law which allows Multi-line Telephone Systems to dial 911 without having to dial any prefix or access code, after Kari Hunt was murder by her estranged husband in a motel and her daughter was not able to call 911(Multi-line). As such the victims will feel like there is a balance.
