The controversy between same sex marriage and religious beliefs has been a reoccurring issue in the United States over the past few years. Not only are religion and same sex marriage controversial issues alone, but there is a direct correlation between the two that makes the situation even stickier than before. In 1964, the United States Equal Employment Opportunity Commission published Title VII of the Civil Rights Act. Title VII states that “no employment should discriminate based on race, color, religion, sex, or national origin.” (Library of Congress, 2017) Title VII is meant to protect the workplace, and this is not shown in the case of Miller v. Davis. Kim Davis refused to provide a marriage license to a same sex couple based upon her religious belief. She stated that her religion does not believe that two people of the same sex should be married, and instructed her employees to not provide marriage licenses to same sex couples. She also stated that by signing her name to the marriage license, she was agreeing with the marriage, which because of her religion, she did not. (Green, 2015) Title VII is supposed to protect employees in the workplace, but the Supreme Court ruled otherwise in this case. The Supreme Court ruled that Davis’ actions were unethical due to the fact that same sex marriage is legal in the United States; she was denying that couple their constitutional rights.
