The Nature Of The First Amendment

Neil Gaiman once said, “The current total of countries in the world with First Amendments is one. You have guaranteed the freedom of speech. Other countries don’t have that.” At the time of the amendments’ creation, a vast majority of operating countries had not yet granted their people such freedoms. Granting every citizen of the United States this right seemed to have been an important landmark in this nation’s history. Along with others, this right is declared to the people in the first amendment of the constitution. The first amendment is the most important because it grants people freedom of speech, prohibits prior restraint, and declares the right to peaceable assembly.

The First Amendment was created in a way, to ensure that all those who seek freedom, in speech, press, religion, and assembling can do so. However, recently freedom of religion has not been fully secured. For instance, there has been bans against immigrants sorely because of their religion stereotype. Something that is contradictory to the First Amendment, "Congress shall make no law respecting an establishment of religion...". The First Amendment should be able to encourage each and every religious freedom, because people no longer feel safe about expressing their religion as the United States government have shown favoritism towards other certain religions. And since numbers are rising in certain religions, diversity should be accepted and shown throughout the U.S. and by the government.

In the beginning, our founding fathers where working on drafting a formal Constitution for our newly formed country. The representatives for some of the newly formed states, worried about the current draft of the Constitution. Many of the states and there representatives, had concerns about the wording of the current draft of the Constitution.

Although a Bill of Rights was not an important factor to the Founding Fathers after the Declaration of Independence in 1776, it was realized that certain rights must be employed for the citizens of America. James Madison insisted that the success of the Declaration hinged on the Bill of Rights to keep American citizens safe from unfair treatment of the Federal Government; in December of 1791 the Bill of Rights was officially added to the Constitution.

This amendment is saying that the press (in general courts have defined the press so as to include all publishers) can write the truth in the newspaper even if it makes the government look bad. The first amendment, which is included in the bill of rights (the first 10 amendments) was ratified on September 25, 1789 and adopted on December 15, 1791. Anti-federalists demanded that they got the bill of rights so that they could ensure that the government didn’t have too much power over them. The bill of rights was written mostly by James Madison. The press were being pressured to write only and exactly what the president or other person wanted them to write. “If law is unjust a man is not only right to disobey it, he is obligated to do so” -Thomas Jefferson. The freedom of the press doesn’t directly apply to everyone because not all people are considered part of the press, but it still in a way applies to most people and is very important. In 1735 John Peter Zenger, a publisher for the New York Weekly Journal, got sent to court for criticizing New York's governor. His paper claimed the governor accepted bribes, removed a judge and tried to fix an election. All of this was the truth. At the time it was illegal to criticize the king, governors represented the king. Zenger argued that

The First Amendment to the U.S. Constitution is part of our countries Bill of Rights. The first amendment is perhaps the most important part of the U.S. Constitution because the amendment guarantees citizens freedom of religion, speech, writing and publishing, peaceful assembly, and the freedom to raise grievances with the Government. On September 17, 1787, the United States Constitution was signed by delegates to the Constitutional Convention in Philadelphia, who were directed by George Washington. The 1787 convention was called to draft a new legal system for the United States now that the states were free and colonized. This new Constitution was made to increase federal authority while still protecting the rights of citizens. It established America’s National Government. In 1971, the Bill of Rights were added to Constitution containing the 10 amendments guaranteeing protection for citizens. The first commandment consisting of freedom of speech and religion. The 1st Amendment forbids Congress from enacting laws that would regulate speech or press before publication or punish after publication. At various times many states passed laws in contradiction to the freedoms guaranteed in the 1st Amendment. However broadcast has always been considered a special exemption to free speech laws for two reasons. 1) the most important reasons is the scarcity of spectrum and the 2) is the persuasiveness of the medium. Because radio and TV come into the house, and may be heard or seen by unsupervised children, the government feels a special responsibility to protect the American people. The First Amendment is the first section of the Bill of Rights and is often considered the most important part of the U.S Constitution because it guarantees the citizens of United States the essential personal freedoms of religion, speech, press, peaceful assembly and the freedom to petition the Government. Thanks to the rights granted by the First Amendment, Americans are able to live in a country where they can freely express themselves, speak their mind, pray without interference, protest in peace and where their opinions are taken into consideration, which is something not many other nationalities have the fortune of saying. This amendment gives us Freedom of peaceful assembly, speech, press, religion and the freedom to petition the Government. It is thought to be the most important freedom of the United States. Only because of this right we are able to speak our mind freely, pray without judgment, express ourselves, and protest peacefully. Our Founding Fathers had been Framers of the Constitution and they are responsible for all the rights documented and established in the United States.
