Should capital punishment be practiced in the United States? This question has been highly debated for many years because of the numerous, often conflicting perspectives from which various parties have attempted to answer it. These parties range from high-ranking politicians seeking to lower the national crime rate to the average United States taxpayer who does not want to see his or her money being spent inefficiently. In addition to such empirical concerns, moral issues such as conceptions of justice arise as well. This country is determined to prove that killing someone under certain circumstances is acceptable, when in all reality there can be no rationalization for the taking of another human life.  Killing is murder.  It is as simple as that.  There have been so many different controversies surrounding this debate that often, the issues become clouded in false statistics and slewed arguments.  The basic fact remains that killing is morally and ethically wrong.  This fact does not disappear by simply changing the term "murder" to "capital punishment".  The act is still the taking of a life.  On these grounds, the death penalty should be abolished.

The Ethics of Capital Punishment Ethics is "the study of standards of right and wrong; that part of philosophy dealing with moral conduct, duty and judgement. '[1] Capital Punishment is 'the death penalty for a crime. '[2] The word "capital" in "capital punishment" refers to a person's head as in the past; people were often executed by severing their head from their body.

Capital punishment has been a debatable subject for decades. Human thinking often ignores the equal-value relationship when it comes to the taking of life. Attention shifts from the victim’s life to that of the murderer. Immanuel Kant believes that moral laws apply equally, and if someone breaks the law, we should make sure that the law applies to everyone. Otherwise, there wouldn’t be such thing as morality. And without morality, life is meaningless. We should be morally strong and be able to kill the criminals, in order to prove that the laws are more important than human life.

Does taking another’s life actually avenge that of another? The disciplinary act of capital punishment, punishment through death, has been a major debate in the United States for years. Those in support of capital punishment believe that it is an end to the reoccurrence of a repeat murderer. The public has, for many years, been in favor of this few and pro-death penalty. Yet as time goes on, records show a decrease in the public and the state’s support of the continuation of capital punishment. Those against capital punishment believe it is an immoral, spends taxpayers’ money improperly, and does not enforce a way to rehabilitate criminals and/or warn off future crimes.

The number of individuals executed via the Death Penalty peaked in 1999 and has been receding at a dramatic rate. As it is becoming less frequently used, its necessity and morality has been called into question. Both sides of the argument offer convincing arguments; however, mounting evidence shows it is cost-prohibitive, it fails to act as a deterrent, it is racially biased, and that the justice system is fallible. I will analyze both sides critically to try and gain insight into why we are part of the 29% of countries who choose to retain it as a form of punishment. Moreover, the two ethical theories I will use to carry out this analysis involve the Harm Principle and Moral Relativism. Both ethical theories can support the pro and con side, so I will be using both as I look at each side of the debate. Using the principles outlined in the Harm Principle and Moral Relativism, I will analyze the morality of capital punishment and access which side the theories gravitate towards.

Hands stained with blood, our justice system still remains battered and broken. States disintegrating the laws that once stood, the laws stealing the lives of innocent, further perpetrating injustice. No matter the decline, abhorrent and controversial execution methods still remain commonplace. Challenge must be made against such methods as lethal injection. Capital punishment, with declining support must be eliminated from our country’s justice system, for the inability to hinder crime, slaying the innocent and underprivileged, while the realization that death is not the perfect punishment sets in.

Deterrence is an idea that criminal laws are passed with clear sentences to persuade individual criminal suspects from turning out to be repeat offenders and to oppose others in society from doing similar criminal activity. It is one of the primary objects of the Criminal Law. Deterrence primary goal is to discourage members of society from committing criminal acts out of fear of punishment.

a) Through the Utilitarian perspective, Bedau is a firm believer in the removal of capital punishment; Bedau thinks that no reason is good enough justify the more severe punishment like death penalty on the moral ground, and no evidence of deterrence and prevention is sufficient enough to support the retribution of justice to keep capital punishment. Bedau have raised several arguments direct to the issue of death penalty: The morality of self-defense and death penalty; the efficiency prevention and the deterrence through capital punishment; then finally the inequity treatment towards the racially disadvantaged and poor.

Capital punishment also known as the death penalty is one of the most controversial issues in today’s society. Many supporters and opponents of the death penalty debate over whether it is constitutional, whether it is inhumane, and whether it deters crime. Some abolitionists view the death penalty as immoral because it violates an individual’s right to life. Other opponents of the death penalty feel that the state should not be allowed to take the life of an individual. Supporters of capital punishment believe it is necessary in society. They assert that it serves as a more appropriate form of punishment as opposed to life in prison. Many people also favor the death penalty because they believe executing an individual will not allow them to commit crimes in the future. Research provides many different arguments in favor of and against the death penalty.
