Available research in the Critical criminal justice issues: Task force reports, shows that the crime associated with drugs has not diminished despite increasingly punitive local, State, and Federal Government interventions and social control (1996). On the contrary, these social issues have shown an increase in the midst of an increasing and costly “war on drugs”. It is obvious that the current correctional system is not correcting anything. The rising number of incarcerated and recidivism does not show that incarceration alone lowers the crime rate. Many of those in jail doing terms could have been handled in other methods over incarceration. A large portion of the population imprisoned is there because they had committed a low-level crime. How can the seriousness of drug abuse warrant a reliance on incarceration as a solution knowing the social significance of incarceration? This paper will address offenders who are convicted of low-level crimes connected to drug abuse, the social implications of the social problem, research data showing the individual and social implications, how society has responded; and the outcome from those responses, a discussion of alternative responses to the problem, and the effectiveness of those alternatives.

Out of all 5 of these issues I think that the use of confidential informants in war on drug is the most harmful to our nation’s correctional system and should be eliminated. This report starts off with an overview of drug courts are, then moves into the overall problem with drug control in the United States. They talk about the history and the rise in drug offenses during the 1980’s causing the prison populations to rise. When comparing the rise of drug offenses, they found it was both state and federal level. The growth of drug offenses became approximately one in every 198 persons was incarcerated. About nine years later, the first drug court was established. Courts, jails, and prisons were seeing a pattern with the number of low level repeat drug offenders and street dealers starting to cause problems with overcrowding . The drug court movement was a shift from law enforcement’s emphasis on reducing drug use.
The realities and everyday necessities in Indigenous communities seem concealed and compromised in the enduring Indigenous criminal law discourse which is framed by issues throughout history, jurisdictions, prisons, courts and the criminal justice system. Whilst today’s intergeneration effects of poverty and the loss of autonomy fuel Indigenous disadvantage, the criminal law institution is another contributor which vividly displays disadvantages and barriers which preclude Indigenous Australians from sufficiently accessing justice. We must enact policies that downscale the prison population. The best approach is to shift resources away from the incarceration and punishment of certain inmate categories, such as nonviolent drug offenders, investing instead in their rehabilitation. Though correction systems have historically favored punishment over ‘softer’ rehabilitation, most nonviolent, drug-related offenders would benefit more from rehabilitation than incarceration. Today, in great part as a consequence of the War on Drugs, our prisons house over half a million drug offenders, representing over one-half of the federal inmate population in the United States, an increase of 790 percent since 1980. It is time for new leadership on the War on Drugs which has cost billions of dollars and has caused the endangerment of inmates’ and correctional officers’ lives due to mass incarceration. Tougher sentencing is not likely to reduce illegal drug use or serious crime associated with drugs (Alexander, 2010; Mauer, 2009; Whitford & Yates, 2009). Despite that, politicians and law enforcement personnel continue to advocate for stronger sentences for those who take or sell drugs of any kind. The jails and prisons across the United States are filling up with drug offenders, and some believe that there are better uses for those jail cells and that there are many crimes that are more severe and significant. These are the crimes that should be provided with tougher sentencing guidelines, but yet illegal drug use is still a serious crime and should not go unpunished. What should be done, and how should changes be made? Those are tough questions that have to be explored and that do not have any easy answers for those who make the laws and those who enforce them. Drug incarceration has been on the rise, with mixed results. According to King (2008), "overall, between 1980 and 2003, the number of drug offenders in prison or jail increased by 1100% from 41,100 in 1980 to 493,800 in 2003, with a remarkable rise in arrests concentrated in African American communities."
In his chapter on “Assessing the Prison Experiment,” he explained that the increase of crime rate is not the sole reason that mass incarceration occurs, and it was also because the courts and the legislature did indeed became “tougher” on offenders (Currie 14). Currie discussed the circumstances of the war on drugs, which was launched by President Richard Nixon. He indicates that the incarceration rate and sentence longevity were increased dramatically since the beginning of the war on drugs. Some of these offenders were given a sentence for more than ten years without the possibility of parole, which is taking away any chance of the prisoner being released before the completion of his or her sentence. Locking people up is a failed attempt to descend the crime rate, and the adoption of mandatory minimum sentencing law is the root of mass incarceration. The government should reconsider the current sentencing laws and reform the correctional system in order to solve the current mass incarceration problem. Furthermore, establishing more community-based programs for youth offenders and initiating early release programs are excellent alternatives to resolve the issue of mass incarceration from both long-term and short-term perspectives, respectively.

The United States incarcerates more people, per capita, than any other nation in the entire world. State and local prisons and jails account for about 80% of incarcerations. Although crime rates have decreased since the 1990s, incarceration rates have soared. According to a recent Prison Policy Initiative publication, approximately 2.3 million people are currently “locked up” in the United States. Of these 2.3 million people, 1 in 5 are locked up for a drug related offense. Statistics show that prisoners and felons imprisoned for drug related crimes are disproportionately Black and Hispanic. The mass incarceration issue in the United States derives from the many arrests associated with these “offenses” regarding drugs and the war on drugs.
Today in the United States a land that claims to be the freest nation on the face of the Earth more people will wake up inside of a federal/state prison or a county jail cell than in any other country on the planet. As of 2012 this figure was a staggering 2,228,400 (jail 744,500; prison 1,483,900) add in to this the additional sum of just over 5 million people on parole (851,200) and probation (3,942,800) giving us a grand total of over 7 million citizens under some level of Federal or State supervision (Glaze and Herberman). This is up from only 1,840,421 in 1980 a percentage increase of 281.56% (Glaze and Herberman). As of 2012 over half of the inmates in the federal prison system (50.6%) were incarcerated for drug charges (Caron and Golinelli) while according to 2011 statistics just under 17% of state prisoners were locked away for offenses related to illegal substances (Carson and Sabol). The cost of maintaining this level of incarceration is in all honesty a tremendous burden upon both our justice system and our tax base. In 1996, Federal Legislation was put in place that banned former prisoners with drug convictions from using food stamps and allowed public housing authorities to ban drug convicts from staying in public housing (Race and the War on Drugs). This negatively impacts the former drug offenders because it provides another setback on top of the plethora of challenges that they already face when leaving prison, like finding a job where the employer accepts former criminals. Having all of these difficulties in readjusting to “regular” society, restrictions set in place by the government now make it harder for these drug users or sellers to remain out of prison. The issue with punishing drug use is that it does not attempt to end the problem permanently and turns to quick fixes instead of long term solutions like rehabilitation and in- prison drug therapy. The lack of desire to help these prisoners is evident in the dropping of in-prison drug therapy since 1991 “despite the fact that almost one in five people in state prisons on drug charges cite the need to pay for their drug habit as the reason for their offense,” (Race and the War on Drugs). With California jails and prisons still struggling with finding a reform for non-violent drug offenders the states recidivism rates continue to reach unprecedented numbers. Between 1983 and 1998, drug admissions to state and federal prisons increased sixteen-fold, from over 10,000 drug admissions in 1983 to almost 167,000 new prison entries for drug offenses in 1998 (Worrall et al, 2009). This has been a direct result of our legal system incarcerating offenders who have substance abuse related issues instead of providing a way for treatment or rehabilitation outside of incarceration. Drug abuse is shown to be connected to all different kinds of crime in the United States, and in many circumstances, crime is inspired by drug abuse and addiction. In fact, 80% of criminal offenders abuse drugs or alcohol (National Association of Drug Court Professionals). Also, 60% of those who are arrested test positive for illicit drugs when they are arrested, and 60-80% commit another crime, typically drug-related, after leaving prison (National Association of Drug Court Professionals). And, even after these individuals put in the time in prison that would allow them to go through the uncomfortable process of detoxing, 95% of them will chose to go back to drug abuse after prison (National Association of Drug Court Professionals). Given these overwhelming statistics, it is clear that drug abuse, and repeated or continued drug abuse, are a serious problem facing the criminal justice system.
This research paper discusses the issues of people who suffer from mental illness being placed in jails instead of receiving the necessary treatment they need. The number of inmates serving time in jail or prison who suffer from mental illness continues to rise. In 2015 the Bureau of Justice reported that sixty five percent of state prisoners and fourth five percent of federal prisoners suffered from mental conditions such as bipolar disorder and schizophrenia. Individuals who suffer from these problems require special mental health treatment for their needs to be met. Many of our prisons and jails lack the necessary resources to care for these inmates and because of that inmates who do not receive the treatment they need are at a higher risk of becoming a repeat offender. Despite the research and findings that show that the criminal justice system is unable to deal with issues dealing with the mentally ill there has been limited solutions put in place. Given the challenges the criminal justice system faces it is important to address the problem and come up with better solutions. This research paper will discuss the various techniques and solutions that scholars have propped and their effect on the issue of mentally ill criminals and how the criminal justice system should approach the problem.
The United States has the world's highest incarceration rate. With five percent of the world's population, our country houses nearly twenty-five percent of the world's reported prisoners. Currently there are approximately two million people in American prisons or jails. Since 1984 the prison population for drug offenders has risen from ten percent to now over thirty percent of the total prison population. Federal prisons were estimated to hold 179,204 sentenced inmates in 2007; 95,446 for drug offenses. State prisons held a total of 1,296,700 inmates in 2005; 253,300 for drug offenses.
