Of course, as more people started owning guns, the crime rate and deaths by gun shot up. Basically, it used to be every man for himself. As the government started worrying farther than just setting the rules but actually having people abide by the rules, laws and restrictions were set to try to regulate who owned guns and why they would use them. In 1934, Congress first started regulating the sale of automatic firearms. Not until four years later did the government think to make it federal law to require gun sellers to be licensed and to prohibit felons from purchasing them (Policy Issue p1). Even with rules that shops were supposed to follow, there are loopholes. The problem with some people in the U.S. is they will go buy guns because they have no criminal record, and then sell it to someone who is willing to pay them for the gun. In the year 2016 alone, there have been 145 mass shootings around the United States, while there have been only 173 days in the years so far. In order to prevent these atrocities from occurring so frequently gun ownership should be regulated by both the federal and state governments through a background check for all sales of firearms. The National Instant Criminal Background Check System has prevented more than two million convicted felons and other prohibited purchasers from buying guns. The law also has a deterrent effect since the prohibited purchasers are less likely to try to buy guns when they know comprehensive background check requirements are in place. However, currently the federal law requires criminal background checks only for guns sold through licensed firearm dealers, which counts for only sixty percent of the total gun sales. The U.S. Congress needs to regulate the obtainment of guns with a background check for all sales of firearms in order to protect the lives of citizens in this country while not violating the Second Amendment and the rights of the state.
In 2012 several mass shootings accrued which reignited gun-control and firearm ownership debates in the United States. There are more public mass shootings in the United States than in any other country in the world. Many of the shooters had a mental illness and most states do not require background checks for firearms purchased at gun shows from private individuals, which is known as the “gun show loophole”.
