In 1978, a man by the name of Stanley “Mark” Rifkin used his advanced computer skills to pull off one the biggest bank heists known to the United States. He ran a computer consulting firm out of his home and had many clients. One of his clients in particular serviced the computers of the Security Pacific National Bank. Stanley Rifkin basically took the elevator down to the D-level where the transfer codes were kept. He sweet talked his way past the younger gentleman on the D-level and into the room where the secret code was posted on the wall. Stanley made sure to remember the code. This would fall under Title 18 Crimes and Criminal procedure, part 1, chapter 4, § 1028: "Fraud and related activity in connection with identification documents, authentication features, and information”. While there has been attempts in the past to introduce and pass laws that specifically apply to phishing attempts none of these laws have made it on the books.

The Internet has vastly expanded the opportunities for identity theft. A particularly prevalent form of cyber theft is known as phishing. This occurs when cybercriminals use spam, e-mail, or other messages to trick people into submitting personal information. As phishing has become more sophisticated, criminals have developed ways to gain access to such data merely by having the user click on the link. Phishers often pool stolen information and sell it on the black market via online forums. Max Ray Vision ran one such site, CardMarkets.com. When Vision was arrested in 2007, computers in his home contained some 1.8 million stolen credit card and bank account numbers. This information allowed Vision and his associates to make more than $86 million in fraudulent purchases.

Being the fastest growing crime of today, it is estimated that every 79 seconds an identity is stolen (Consumer Reports 13). Empty promises made by solicitors in spam e-mail offer a free gift in exchange for personal information. These solicitors have no intention of sending any free gifts, but their scams help them obtain the private information desired. If enough information is given, criminals are able to apply for credit cards, apply for a fraudulent loan under the victim’s name, and make illegal withdrawals from random bank accounts. This is only one of the many ways a person’s identity could be stolen (O’Reilly).
The FBI exploited Eric Eoin Marques, a US-born 28-year-old, using buffer overflow methods. Marques is accused of creating and engineering Freedom Hosting, the hidden website indicated to be responsible for facilitating child pornography on 550 servers throughout Europe. One FBI agent declared that Marques is undoubtedly 'the largest facilitator of child porn on the planet".5
These people have more opportunities to commit a white collar crime than a person with little authority. Peter Michelmore, a journalist for Readers Digest describes this situation well in his article, "On the Trail of a Scam" He describes a savings and loan scam and the man behind it all. "Meyer learned that New Era was run by John G. Bennet, Jr., a 57 year old evangelical Christian." (112) New Era was a getting money from a private university, in which he promised huge returns on their investment. New Era did show them huge profits, but only to gain their trust and invest more money. The private university was gaining trust in New Era and investing more money. Finally, when They had invested a large sum of money, New Era collapsed and John Bennet walked away with the university's money. Mr. Bennet is a prime example of our findings. He is a man over the age of eighteen and he is in a position of power. People have entrusted him with their money. To commit his crime, he needed to be in a position where he was trusted, or in authority. After he won their trust, he took their money. White collar crimes are growing at an alarming rate and must be curbed. There are many things that the nation can do to slow the growth of these crimes.
