In effort to help you prepare for the upcoming Multi Disciplinary Team meeting for the case The State V. Sam Ruth, you have asked me to look further into the following concerns (1) Wendy’s “normal” medical exam findings. (2) Wendy’s diagnosis of a Urinary Tract Infection (UTI) and if it is relevant to her disclosure of sexual abuse; (3) Wendy’s resistance with testifying in court; and (4) Wendy’s recent recanting of her allegations of sexual abuse.

This is possibly the hardest assignment I’ve had to do to date. It’s difficult to examine how much this little boy had to suffer at the hands of his father. The crimes that took place here were more than abuse. I believe that the case worker is culpable for refusing to protect the child and should have been disciplined if not charged with a crime. The mother deserved a more severe sentence for allowing this abuse to go on for so long and should have been charged as an accessory to the crime. This case did lead to outrage and sweeping legislation in the state of Washington was enacted. Most of the legislation was aimed at allowing and even mandating that child protective services make protecting the child a higher priority than keeping the family together.

A nine year old in Oregon was removed from her home by child protective services in 2010 and placed into the care of Kamlo and Dwight Reed. Even though the state Department of Human Services allegedly knew that Dwight had been accused of sexually abusing a another foster child, the adoption still went through. After the Dwight couple abused the young girl sexually, physically, and emotionally, a a guardian who was court-appointed for the child filed a lawsuit against the department in 2016. If the agency had looked into the allegations, the child would have likely been saved from suffering through years of abuse by being placed into a different home. The social service workers receive a large amount of cases each year. According to the U.S. Children 's Bureau, children protection agencies received nearly 3.6 million reports of abuse or neglect concerning 6.6 million children; however, the agency only reported roughly 702,000 children who suffered from abuse, including 1,580 children who died. The number of cases reported is less than ¼ of the cases received. If the agency discovered some of the 1,580 cases quicker, adolescent deaths

“I just knew the phone would ring some day and Joshua would be dead,” stated social worker Ann Kemmeter regarding Joshua DeShaney and the ongoing abuse he endured from his father. Joshua’s father brutally and repeatedly abused his four-year-old son Joshua (Wichenbach). The State of Wisconsin was aware of this abuse, but still did nothing to intervene and stop the mistreatment of this child (Wichenbach). The State’s inaction led to the Supreme Court case DeShaney v. Winnebago Department of Social Services, in which Joshua’s mother, Melody, sued the Winnebago Department of Social Services claiming, “the social worker deprived Joshua of his liberty without due process of law” (Alexander). In order to fully understand the DeShaney case, one must conduct thorough background research, delve into the court case itself, and analyze the impact the case has yet today.

According to the National Children’s Alliance, one in four girls and one in six boys under the age of eighteen are at risk of being sexually abused but only according to what is reported. In the State of Texas, a professional has forty-eight hours to report any cause to believe a child been abused as stated in Sec. 261.101. As a foster parent and principal, Angela Sugarek and Carol Jeffery had a major moral responsibility and legal duty to report what her three year old foster son was displaying: behaving strangely and an anal injury.

REPORTER: The reporter/not related (Amy) called with concerns for the victim, Dayne. According to the reporter, Mindy (mother) doesn’t work, and she wears a neck brace. Mindy has dizzy spells, but she continues to drive with the child in the vehicle. The reporter said Mindy is not caring for the child. Mindy claims that she is sick to get rid of her child, and Gary keeps the child every night but he is not abusing or neglecting the child. At 8 years of age, he displayed encopresis, beating his head on tables, and displayed aggression by striking others. The boy identified his father as the offender of sexual exploitation, and reported him to law enforcement. There was medical evidence of abuse, and there was three to four reports made. Nevertheless, based the assessor’s report, the court of law placed solitary physiological custody to the father. The court ignored the medical proof of exploitation, which contained cigarette scorches, and the child’s requests to be placed with his mother were denied. The boy was remanded to his mother. The boy has few visits visitation with mother, and the boy’s lawyer did not persist the boy’s desires. This sounds so familiar after reading the story of Beth and Sam. The boy suffered sexual coercion and rape since they are 3 to 4 reports, and the child is treated as if his opinions and viewpoints do not matter. It seems the interview of a child should be conducted in expectation of a legal debate, and the attorney acted against the child and mother’s necessities. I hope to use my law degree to change the lives of mistreated children from all over the world. As a victim of child abuse, serving this community has become a part of my identity. My aspiration to represent mistreated children, albeit vitalized by personal turmoil, has been intensified through professional experience. Through my work with Child Protective Services (CPS), during an internship with a family law attorney, I developed my passion for advocating on behalf of children. While working on CPS cases, I have seen how the lives of children can improve through diligent efforts by authority figures. Child abuse has an impact on the many crimes America faces. Child abuse is not always easy to distinguish at a quick glance and can go on for years without someone knowing. Many criminal justice practitioners are involved in these cases. Between psychologist that help the children recover ,and find out their stories to the police officers who arrests the offenders, Child abuse is a delicate situation and takes the upmost care.

My field placement will be at Child protective services in El Paso TX. My Target population for my field placement will be Children who have been maltreated, neglected and abused. Child abuse prevention has grown exponentially in El Paso over the past 31 years. In El Paso alone the Texas Department of Family and Protective Services investigated 4,979 reports of alleged child abuse in 2014 in El Paso County. They confirmed that 1,339 children were indeed victims of abuse; 379 confirmed cases of Physical abuse, 166 confirmed cases of sexual abuse, 56 cases of emotional abuse and 70 cases of medical neglect (Lee & Beulah Moor,2016) A troubling trend has emerged regarding the prevention of child maltreatment in the state of Texas. A tragic loophole contributing to continued abuse and in many cases child fatalities, continues to be exploited to the detriment of one of our most vulnerable populations. From 2009 to 2014, there were 800 child fatalities reported as abuse and neglect deaths by Child Protective Services in all of Texas (Ball, 2015). An analysis of these cases by an independent research group found gross errors by CPS and other agencies during ongoing abuse cases enabled the abuse or neglect to continue, inevitably leading to death. Although the percentage of child fatalities is just a tiny fraction of the exorbitant number of cases CPS handles each year, even one child losing their life in such a horrendous fashion is too much. History tells us that child abuse and neglect have been present in the United States since its origination. In an attempt to help prevent this from happening and supply aid to those in need, the federal government created The Office of Child Protective Services. The Office of Child Protective Services provides several functions for the Family Services Division of the Department of Human Resources. The child protective services includes maintaining the Central Registry on Child Abuse and Neglect, applying for and monitoring grants for protective services projects and providing case consultation services. The social work intern provided assistance to a case worker that received a case that was reported by The University of South Alabama’s Children’s and Women’s Hospital. The report stated that an African American 16 year old male was admitted for diabetic ketoacidosis with hypotension due to severe dehydration. The client was admitted to The University of South Alabama’s Children’s and Women’s Hospital eight times within this year. The client and his mother were noncompliant with medication and treatment. The client’s doctor stated that the client would not survive if noncompliance continues. The client’s primary system that this report disclosed was that the client is in danger because he is not taking care of himself by not taking his medication.

For generations, Satanism has been an infamous religion full of misconceptions. Some courts and social service workers are unable to identify signs of child abuse and child abuse that goes unnoticed can create some very violent outcomes. This can be best shown in the cases of Jacob Ind and Nathan Ybanez, two juveniles in Colorado, who killed their parents. Both Ind and Ybanez were abused physically, emotionally, and sexually by their parents. When Jacob Ind’s older brother went to social services to ask them to help his brother, they didn’t even open an investigation into his report. As a result Ind continued to suffer abuse at home until he couldn’t take it any longer and he killed his mother and stepfather.

Getting treatment for a victim of child sexual abuse is a difficult process because of the lack of trust by the child. Dave Pelzer was abused for many years enduring a stabbing and prevalent beatings of rage from his intoxicated mother. If that wasn’t enough in itself, neglected by his “hero”, the father who quite possibly could’ve been the only one who could save him. Pelzer was mentally and physically abused from ages 4-12 before his teachers put their livelihoods on the line to save him. His case ranks the 3rd worst case of child abuse on California record.
