The criminal justice system is effective in achieving justice, in relations to police power and authority. Police are tasked with an essential role in protecting and enforcing the law. They are a critical aspect towards the criminal justice system and the criminal investigation process. To assist their role to the community, they’ve been provided several types of powers and authorities to achieve their duties towards the community. These authorised powers are used to stop, search and detain a person when they’re certain a crime is committed. Consequently, police can use this authority to potentially violate another individuals’ right, such as privacy. Whilst this power allows police to fulfil their duty to the community, is that justifiable to violate an individuals’ right?

When we think about rights, we also must think about the safety of the officer and everyone else around at the time. Multiple reports have shown that police are taking their jobs so seriously, they are willing to break the rules. This results in people losing their rights to privacy. What people do not understand is that they do have the power to say no when a police officer asks to search their cars or their person when there is no probable cause. The bone of contention is that people tend to have no will power to abnegate an officer. With that being said, people should understand the limits that cops can and cannot reach when it comes to arresting or fining a person under certain circumstances. If a person has evidence that there is no justification for the cop to search them, then in no way is it wrong to say that they do not give them the right to search.

I have always viewed the justice system from the viewpoint of the law enforcer. Having a father being a deputy and an uncle in the police force, I have always had a sense of fear of this authority figure. Those in charge are there to protect us and we are to abide by the rules in which they enforce. If we break these rules, there is going to be a series of consequences.
