The constitution was signed by delegates of the Constitutional Convention in Philadelphia on September 17, 1787. There are several ways in which the constitution guarded against tyranny. The constitution was made to protect the people of the United States. Four ways the constitution guarded against tyranny is federalism, separation of powers, checks and balances, and big states vs. small states.
The first way in which the constitution guarded against tyranny is federalism.
Federalism is a system of government in which the power is divided between the federal government and state governments, which you learned in document A. Federalism helps make sure that the federal government doesn’t get too much power. Separation of powers means that in the United States government powers are split among the three branches of government which are: the executive branch, the legislative branch, and the judicial branch, which you learned in document B. The separation of powers helps guard against tyranny by making sure that one specific branch doesn’t gain too much power. If one branch were to gain an excessive power, then that branch would have more say than the other two branches which could result in tyranny.
The third way in which the constitution guarded against tyranny is checks and balances. Checks and balances are how each branch of government has a certain amount of influence over the other branches of government, which you learned in document C. If one branch believes that another branch is doing something unconstitutional then they have the power to veto it. Checks and balances help guard against tyranny because one branch cannot have an excessive amount of power and do as they feel is correct because the other branches have the power to stop
Another way to guard against tyranny was the checks and balances; that all the different branches of government can disagree with something that another branch is doing in order to keep everything in the government fair. One way that the constitution shows this is when it is put that the other branches can veto something that another branch is doing because it may be unconstitutional. According to the document C there is a diagram showed the relationship between the three branches, which were legislative branch (Congress), the executive branch (President) , and the judicial branch ( The Courts). These three branches each shares powers with each other so that each can contend with each branches. Examples of this are how congress has the ability to impeach the president, how the president can veto the laws the legislative branch make, and how the executive branch can nominate judges(Doc C). The task of each representative was to come together to create ideas without letting one person or any one group be in hold of too much power in order for the central government to grow stronger. The main challenge was to generate a Constitution that would be strong enough to retain possession of power for each state to a minimum so not a single person was the only one to have power or control. “(L)iberty requires that the three great departments of power should be separate and distinct.” (Document B) For our government to be successful we much create three main levels of government where powers are distributed. This guards from tyranny because it makes sure that no branch has more power than one another because they check each other. Document B states that in the Constitution article 1 section 1, article 2 section 1 clause 1, and article 3 section are about the three separate branches in our government and what responsibilities that each one holds. With our government having three different branches each one has its own limited powers that make a democracy possible. This guards against tyranny because no branch overpowers each other, nobody gets too much power, and the powers are evenly distributed. Separation of powers is one of the main things framers used to protect against tyranny.
