Transnational Crime is nothing new across the country. It covers a wide range of crime that includes human/drug trafficking, cybercrimes, and weapons trafficking etc. However, since laws and law enforcements officers differ from country to country catching traffickers coming into another country could be hard. In addition, to using people; traffickers now use shipments via air to help them traffic drugs. For years, the borders of Mexico and the United States has been used to smuggle drugs between the countries with the intent to distribute the drugs to local drug dealers for a profit or maybe other reasonable gains.
Drug trafficking is the most common, it is defined as, “manufacturing, distributing, dispensing, or possessing with the intent to manufacture, distribute, or dispense any amount of a prohibited narcotic”(Theoharis, M., July 6,2015) Although, there isn`t a clear definition on drug trafficking for Mexico by reading the punishment, it means the same for the United States definition. In addition, to drug trafficking between the countries,drug trafficking is a felony in both countries. However,the penalties are different. In the United States, federal drug trafficking has mandatory sentences depending on the narcotic and the amount. In brief, the United States follows man made laws that have been put in place by judges, therefore decisions are made based off other situations or cases that are similar to the cases before them. Whereas, Mexico is simply by the Book. Decisions that are made is based of the laws from a book. In comparison, both countries has a system that they follow in determining sentences for Citizens that violate the law although the United States has a judge that has made the law Mexico judges doesn`t play a vital role in the law making decisions of that
