Does Religious Discrimination Really Exist in Today’s America?

Introduction
There is so much controversy when discussing different religious beliefs. Everyone has a different belief system, and who is to say which is right or wrong. Accepting these differences and avoiding judgment against those with different beliefs is the end result we are looking to achieve as Americans. Unfortunately there are a lot of opinions on what religious beliefs are acceptable and what religious beliefs are unacceptable. The ultimate goal is for everyone to accept that their religious beliefs are not right for everybody.

The supervisor then assigned tasks like climbing a ladder to other employees who were dressed more suitably for the task. As time went on the supervisor retired and a new supervisor was not as accommodating to the female employee’s religious beliefs, so the female employee was instructed to return to the required dress code, and that they would no longer reassign tasks due to her attire. The female employee did not return to the pant dress code and later tripped and fell from the ladder. The supervisor gave the female a written notice that she was to return to the pant dress code, or she could contact Human Resources to see about a transfer to a different position that did not require the pant dress code. The female employee did not return to work due to her inability to accommodate the dress code requirements that conflicted with her faith and her lack of experience for other positions offered at the time of the incident; the female was terminated for refusing to come back to work. In this case the employer produced sufficient proof that they did make reasonable accommodations to support the employee’s religious requirements, but the employee’s attire was causing undue hardship on the company. In order to establish a prime facie case of failure to reasonable accommodate religion, Mrs. Cloutier has to demonstrate: a sincere religious belief that conflicts with the dress code policy, that Cotsco was informed on the conflicting belief and the policy, and that she suffered an adverse employment outcome due the religious belief. Cheryl Perich was an employer of the Hosanna-Tabor Evangelical Lutheran Church and School and filled an employment discrimination suit for alleged violation of the Americans with Disabilities Act. Cheryl became sick and left work to be on disability, but then was not able to return to her position and allegedly urged to resign. When she refused resignation, her employer Hosanna fired her. The EEOC then filed a discrimination suit against Hosanna-Tabor, which was dismissed. Upon the appeal by Perich and the EEOC, courts ruled that Perich was not a ministerial employee and the case must be retried on the merit of the discrimination claims. In this case, 10-553, the appeal was reversed and the U.S. Supreme Court ruled that Hosanna-Tabor’s actions were lawful.
First and foremost, the controversy over religion is relevant because there is not just one religion that everyone in the world believes in. Each religion offers a different set of beliefs that influence followers, and each major religion claims that their beloved God is the only God and he is correct in every aspect of the metaphysical life. Despite the billions of followers, scientific evidence of a God, heavens, or any other supernatural figures that are commonly worshipped by religions will never be found. The most popular religions are monotheistic, and rely on a book with a set of rules to live by, and also claim to provide more to life than what is here on Earth. More specifically, the Christian Bible claims that there is only one God and his only son’s life was sacrificed for our sins in order to allow each and every human to live a Christian ruled life that would result to eternal afterlife in the realm of heaven (John 3:16). The United States Supreme Court, as well as federal district and state courts, defines employee rights and an employer’s liability for employment law violations. Treatment on the job, including hiring, firing, and promotions, must be based on qualifications and merit and not on race, gender, age, sexual preference or how one responds to sexual advances. Yet despite these laws and policies, many employees continue to suffer from workplace harassment and employment discrimination.
The prejudice experienced by Catholic Americans can be traced as far back as the sixteenth century. Roman Catholicism was the dominating religion throughout most of Europe and the Catholic Church held great wealth, social, and political standing. The loyalty of the people to Rome and the Papacy at that time seemed to be unyielding until an Augustinian friar, named Martin Luther, rejected some of the teachings of the Roman Catholic Church and began to spread his own message of God’s will in the form of Lutheranism. Under Title VII of the Civil Rights Act of 1964 states that all employers must make practical accommodation to hold spiritual beliefs of their employee absent unwarranted hardship, therefore it is not considered discrimination (EEOC.org). Eric Brene once said, “The moment a little boy is concerned with which is a jay and which is a sparrow, he can no longer see the birds or hear them sing.” This quote is not only powerful and alarming but it too can shed some light on the situation here in America regarding discrimination. Discrimination is a plague of society that has cast a shadow over this country and has caused tension among us in the process. The question remains: is discrimination killing America? Discrimination is defined as, “treatment or consideration of, or making a distinction in favor of or against, a person or thing based on the group, class, or category to which that person or thing belongs rather than on individual merit,” (Dictionary.com 1). This debate over whether or not discrimination is killing America is more prevalent now than ever, with the case of Ahmed Mohamed. Ahmed Mohamed was simply a 14-year-old student, who brought an invention that he worked so hard and diligently to produce into school, and ended up in prison. The reason as to why he was put in handcuffs and taken from school: a clock. A homemade clock in which he made, and brought into school to show one of his teachers, caused Ahmed to be arrested. There is heavy debate as to whether or not the clock did look a bomb, but without a shadow of a doubt, that the clock was labeled as a bomb due to Ahmed’s nationality. In the case of Christopher Polk while working for FedEx, the company has a grooming policy Title VII in place for its employees. The policy is in place for the employees that have direct contact with FedEx customers. The policy states that no employer can discriminate against a person due to their color, race, religion, sex, or nation origin. In addition, Mr. Polk dreadlocks are a connection to his religious beliefs. The policy is a little outdated due to the change within employee’s beliefs and religious practices. Mr. Polk’s employer advise that his dreadlocks are outside of the grooming policy on a “reasonable style” (Bethel, 2017). Christopher was “order to cut his hair or be moved to a different department with lesser pay (Bethel). Because of his beliefs he was fired and ended with a lawsuit against FedEx. He felt that his rights were violated and he sued for religious discrimination. The policy was not violated when he decide to have dreadlocks. It is an extension of his religious beliefs and it should have been treated as such. Other employees were treated the same as Christopher Polk and lost their jobs as well.
One of the most controversial topics of modern times is actually not all that new. People have been arguing for centuries about a multitude of subjects and how they influence the big picture as well as the day to day norms. Religion has and always will be a hot subject because of this; However, philosophers have developed theories and guidelines to help people to realize what is most suitable, important, and critical in their spiritual lives. However, the Philosophy of Religion caters to everyone, not just "believers". Today we will look at Thomas Aquinas and Fredrich Nietzsche and their takes on religion.

Discrimination is defined as negative attitudes or behavior between people with differences. Frequently, opponents label each other with spiteful words. However religious discrimination can lead to violence. Many times religious discrimination can cause judgment during employment, limited educational opportunities, and restrictive social interaction. Throughout the centuries, Judaism, Catholicism, and Islam have been negatively persecuted by numerous communities. Religious discrimination has impeded the right and ability of Jews’, Catholics’, and Muslims’ to practice freedom of religion rights worldwide. For many people, religion is a very touchy subject. For most, it is a personal decision; people choose a faith that aligns with their beliefs, ideas, and faiths. Although people would like to think that religion is a personal decision, and they can adapt it to how they feel and what they believe, in practice, that is not the case. Religion represents a commitment to a set of principles that are not moldable, adaptable, or flexible. Religion, although it may be a personal belief, it is extremely defined, with little to no room for flexibility. Individual that doesn’t meet the requirement of the company are required to cover them up, or not wear the piercing or hair styles at work. However, companies that demand these codes must be consistent throughout their company regardless of the position the individual holds. In some cases, employees who have a violation of the dress code can be required to work outside the view of the customers. Religion has always been a controversial subject and it always will be. The reason why is simply because far more people do not take the time to become educated on all the different types of religions and different religious traditions practiced by people all over the world. These religious traditions play a huge role in every culture and without taking the time to learn about what others believe in it is so easy to make assumptions for an entire group of people just because they are from a certain country, upbringing, or even because they have a specific appearance. The study of religion is crucial in the twenty-first century for so many reasons but especially so that you are not ignorant towards other cultures and to broaden your own beliefs.
