The current system revolves around the five facts which due to their nature have been criticised as “a mixed bag of separation and fault-based facts at best illogical and at worst destructive”. However, the current system has its reasons for operating the way it does. It encourages reconciliation but at the same time discourages a clean break which is one of the central aims within divorce law. With an increasing number of divorces the law must adopt to different social, economic and cultural circumstances and is bound to change as the requirements of our ever more complex society

There is a staggeringly large amount of divorces in the United States (US). In total, the US had a recorded total of 2,140,272 marriages in the year 2014 alone, and of those marriages, 813,862 ended up in divorce or annulment (Center for Disease Control). This means that as recently as 2014, there was a divorce rate of approximately 40%. This supports the statistics that the divorce rate for the US has stayed within 40-50% since the 1970’s (Austin Institute, 2014). While the numbers themselves are important, it is also important that the causes for the high divorce rate be explored, so that it can be known what pitfalls to avoid when participating in such an important union as marriage. There are many causes of divorce in the US such as conflicting gender roles, socioeconomic status, religious conflicts, physical abuse, emotional abuse, alcohol addictions, and many more (Amato & Previti, 2003). This paper will look at many of these reasons, but it will also focus on the differing reasons reported by men and women.

In the terms of Divorce – the legal termination of marriage, this has increased immensely since 1971 due to the change in legislation that had liberalized divorce, made it cheaper and easier to obtain. The Divorce Reform Act of 1971 was the most important because prior to 1971, one partner had to provide ‘evidence’ that they had been wronged by the significant other (matrimonial offence). Due to the change of the law, it allowed people to divorce on the basis of “irretrievable breakdown”. In addition, since 1984, the Matrimonial and Family Proceedings Act reduced the time limit for divorce for a minimum of 3 years of marriage to only one year. After this act, the divorce rate shot up again, as it did in 1971. Now, people were finally able to legally to end all connections, as previously when divorce was either too expensive or difficult to obtain, separation was very common, which was when a couple decided to live away from each other.

Over seven billion people living on earth we are all diverse in our characteristics. We live in societies made up with laws and don’t have the freedom to exploit another person right. People who disobey laws and misuses another person rights are known as morally sick and selfish. They never bear the shame of their actions and always fails to understand others. While laws only ensure peace in a society, families that makes a society needs better understanding between a husband and a wife. Now with divorce rate that is growing higher by each year, Sociologists and psychologists are pointing many aspects and actions of couple that must be taken into consideration before we expect a happy life. Throughout history, divorce has remained a controversial topic. Perceptions of divorce have drastically changed essentially because the value of marriage has changed. Marriage was once seen as a practical necessity and an irrevocable commitment. The view of marriage caused divorce to be perceived as a stigma. Divorce in earlier generations was not granted by the court system unless there were extenuating circumstances (Evolution). For example, if the woman in the marriage was unable to conceive children the divorce would be granted to the man. This remained the standard practice until the 1970’s with the introduction of “no-fault divorces” (Croteau).

Divorce is becoming all too popular in our society today. When a couple experience tough times or have one too many arguments, they automatically think divorce. Despite its prevalence couples are not prepared for it’s long, drawn out, hurtful process. Divorce does not only hurt the individuals involved, it also affects the children tremendously. While many people don’t think divorce is a bad thing. Hollywood makes divorce look cool and uneventful. When in all reality, it is disruptive. Some people would say that divorce is a lazy way out of a marriage; the cowardly thing to do when a situation presents itself. Divorce is not the only answer to marital problems, in most cases.

There are three main causes of divorce: changing in woman’s roles, stress in modern living, and lack of communication. The first significant cause of recent rise in the rates of divorce is a woman’s role being completely changed. In the past, men had to earn all the money to afford the expenses of the family, whereas woman only did housework. That led to the woman having no money

People in America are determined to get married and live together. Married couples want to share everything and depend on each other. However, fifty percent of these couples cannot seem to fulfill their marriage vows. As a result, they choose to get a divorce. Divorce is very easy to do nowadays unlike the past. Statistics show that the four main causes of divorce are: financial difficulty, women are more independent, infidelity, and couples are getting married at a young age.

From past to present people all over the world have determined to live together, or “get married”. People in society perceive that due to the financial independence of women in the Hindu families, divorce rates are increasing . The increasing divorce rates are taken equivalent to the women empowerment . But, in 2001 census, the national divorce rate was at 0.3% for males and 0.2% of females , which is slightly more than what the divorce rate was in 1970 and 1980 at 0.2% to 0.14%of the total population in 1970s and 1980s,respectively .Though the divorce rates in India are increasing, they are still much lower as compared to the nations like Sweden, U.S, Russia ,where the percentage of marriage that end up to divorce are 54.9%, 54.8% and 43.3% respectively. Even in the neighboring country Sri Lanka, the divorce rate is higher at 1.5%. But, lower divorce rates in India don’t indicate that the couples are in harmony with each other . Divorce rates are low primarily because the women are forced to keep their marriage intact .Actually, there are a greater number of women, who feel extremely exploited in the institution of marriage, but they are compelled by the circumstances to bear the burden of their marital relations. Besides, there is a need to analyse how divorced women

“DIVORCE” – Just the sound of such word in any married couple or children’s ear can cause great agony that can even become terminal. Research and personal experience, has proven that in today's society, divorce is more common amongst newlyweds. Since 2009 the rate of divorce has increased to approximately forty percent, There are three out of every ten marriage that ends up in divorce before it reaches the stage of maturity, and the most prevalent results are – lack of communication and infidelity.

Divorce has progressively become a common procedure worldwide, affecting not only parents and their offspring, but also the communities that surround the family unit, and consequently presenting a terrifying threat for the affected child. Nonetheless, regardless of the conventionality of divorce, it persists to affect various aspects of children's' daily lives and rituals. Children and adolescents are consequently deprived of a customary and stable family upbringing and thus suffer the disadvantages of a single-parent family structure. Divorce can be signified as a common legal procedure for the dissolution of a marriage, which ultimately results in the separation of two parents and inevitable division of property and final custodial
