Discrimination: The United States Vs. Stanley Case

There were many cases during the civil rights movement that helped shape the world into what it is today. By the middle of the twentieth century, black people had long experienced a physical and social landscape of white supremacy, embedded in policy, social codes, and both intimate and spectacular forms of racial restriction and violence. It was time for a change. The Supreme Court made many decisions to change and affect this movement. Some of these these cases are Dred Scott vs. John F.A. Stanford, Plessy vs. Ferguson, and Shelley vs. Kraemer.

Supreme Court cases like Loving v. Virginia (1967), Swann v. Charlotte-Mecklenburg (1971), and Bakke v. University of California (1978) made the government realize civil rights were a serious problem. The Plessy v Ferguson case also resulted in the formation of a new set of laws known as the Jim Crow laws. These laws made segregation legal. Everything became segregated, from schools to bathrooms to even their jobs. The Jim Crow laws also developed until there were laws that kept African Americans from voting and running for positions in office. All of the progress and advances that had been made during the Civil War were slowly being lost.

In 1973 a thirty-three year-old Caucasian male named Allan Bakke applied to and was denied admission to the University of California Medical School at Davis. In 1974 he filed another application and was once again rejected, even though his test scores were considerably higher than various minorities that were admitted under a special program. This special program specified that 16 out of 100 possible spaces for the students in the medical program were set aside solely for minorities, while the other 84 slots were for anyone who qualified, including minorities. According to Melvin and Katz (2015), Lian’s denial of promotion falls under the mixed motive theory of discrimination. Mixed motive theory applies when motives are both legitimate and discriminatory, thus providing protection under Title VII. The court case came about when Plessy [a man of mixed race, one eighth black to be precise)], sat in a white’s only railway car in New Orleans. He was asked to vacate the car, but when he refused he was arrested and awaited trial. After getting a lawyer, he appealed and was able to have his case heard by the Supreme Court. This law allowed further segregation legislation to pass, and justified racial segregation in many institutions (such as school) establishing a Jim Crow system (Horton and Moresi 2001). This legislation rationalized segregation, as long as everything was “equal”, but nothing really changed. Further, this ruling would be overturned and new legislation in the interest of African Americans would rise.

The ruling of this case was a major landmark in United States. It affirmed that the congress could make use of its constitution powers provided under Commerce Clause to make privately owned businesses abide by the provision of Civil Right Act of 1964. In addition, the ruling of this case was a major step in fight against discrimination of African Americans. It illegalized private discrimination for the first time.

The Supreme Court's decisions cause numerous amounts of controversy due to ignorance of racial balance, especially during the era of slavery and in three specific cases. At this point, slavery and segregation was a large problem. Colored people were not treated equally and were slaves, yet not even in court were they treated equally. These people were convicted of crimes with little to no evidence just because of their race. The Supreme Court's decisions cause numerous amounts of controversy, especially during the era of slavery, making these three cases influential because the controlled views of the nation are seen through the court, so whatever the court sees is what the nation views, and in a find example, three specific cases: the first case is Dred Scott v. Sanford (1857), the second case is Plessy v. Ferguson (1896), and the third case is Swann v. Charlotte-Mecklenburg Board of Education (1971).

Discrimination began as something that defined social organizations and groups. Many discriminatory aspects such as race, gender and ethnicity increasingly became a problem within capital sentencing as the years passed. Racial discrimination for example happened during the 1850s. One trial in specific, the Dred Scott v. Sanford case demonstrated racial inequality by denying all blacks any human rights. This case “symboliz[ed] the high point in American law, but it also helped lead to the adoption of the Fourteenth Amendment, which has been the fountainhead of racial equality in the 20th century”(Finkelman 1). As children grow up, they become the person they turn out to be because of experiences and the culture and society they grew up in. Nations are affected in the same sense because the people living in a nation affect how the nation is influenced and builds its character.

During the civil rights movement in the 1960s, they were able to abolished slavery but that doesn’t mean that it ended discrimination. African American was still being discriminated in various location. From vehicles, bathrooms, libraries, benches, schools and etc. Also, people discriminated African Americans as well. In Mississippi was a state that was against the civil rights movement, and devoted to segregation and discrimination towards colored people.

The ruling of the Supreme Court in this case became law. It did not gain the Negros any more rights or equal opportunities. Still, it was the first step towards desegregation. It also made people realize that there was still injustice between the races. Justice John

Have you ever walked into a Starbucks and within two minutes the police escorts you out for no good reason? Can you envision being shot holding a device the cops “feared their lives over”. Imagine being a suspect of interest because a crime was just committed, and you are being just walking home on my regular route but never make it home or even to see another day. “Oppression and discrimination are closely related, as all acts of oppression are also acts of discrimination.” This terror and anxiety occurs every day for African Americans. An individual is set to believe the purpose of the Justice System is to “deliver justice for all, by convicting and punishing the guilty and helping them to stop offending, while protecting the innocent,” nonetheless with the lack of acceptance because the color of their skin it is hard to get by without looking over your shoulder.
