There is an extreme difference between the criminal justice systems used in Norway with that of the one used in Texas. In Texas, we see a tough justice system that seeks to punish the guilty. On the other hand, Norway attempts to teach its prisoners to be good citizens by treating them with respect, like normal people. On this essay I plan to compare and contrast both criminal justice systems and discover which one is the best approach. On Norway, we see and extremely different view of how to treat criminals. They as serving prisoner of Skien maximum security prison, Baster Petter states “give us trust and responsibility.” Despite the gravity of the crimes, the loss of liberty was all the punishment they suffer. They even have cells, televisions, computers, integral showers and sanitations. In addition, the maximum sentence is only twenty-one years and with no death penalty. Their sentencing for major crimes such as murder is surprisingly low, which I do not agree with. If a person took one’s life, they deserve maximum punishment, not only 21 years, when in Texas you could possibly serve a life sentence. In contrast, Hernu’s story “Norway’s Ideal Prison” from One World, Many Cultures talks about the world’s first human “Ecological Prison” on Bastoy Island, Norway. Bastoy Prison is Norway’s largest low-security prison. On the island murders and other violent felons are found, but the guards trust them with knives, chainsaws, and other weapons. “‘I have not had one violent incident here,’ the governor continues. ‘One inmate did managed to escape by stealing a fishing boat one night, and his punishment was to be sent back to a closed prison’” (Hernu 247). Bastoy prison is pretty lenient, and laid back when it comes to prisoners but if you break any of the rules you will be sent back immediately. Frank, a cattle herder said, “‘…For the first time in my life I feel motivated and believe in myself. I really believe I can break my circle of crime’” (Hernu 250). The results Bastoy Prison has produced shows that the “Ecological Prison” does work.
Texas had always had a long standing history of being traditional and conservative; their strong ties to tradition and pride in history has caused them to remain steadfast in some of their practices regardless of the world around them. Texas is amongst the few states in the U.S. that still actively participates in capital punishment. In 1982, the state became the first jurisdiction in the to carry out an execution by lethal injection, since then Texas has executed more than a third of the national total.
The United States and Norway have very different philosophies when it comes to the purpose of correctional facilities. Prisons in the United States focus on punishing the offenders for their crime. However, Norwegian prisons focus on rehabilitation. There are pros and cons to both the American and Norwegian maximum-security prisons.
Texas Capital Punishment is not as reasonable as one might assume. It is not reasonable since there have been many innocent individuals who have been executed. One might wonder how an innocent individual is given Capital Punishment, and through out the Trial he or she is found guilty and hurl for execution. Many facing Capital Punishment are underprivileged individuals who cannot afford a private lawyer, in which he or she relies on the State of Texas to appoint an attorney for them (Byrd & Price, 2008). Much of the time, the appointed lawyers are overloaded with cases, don’t have time to review the case before trial, and don’t have trial experience required for a capital punishment case (Byrd & Price, 2008). Although the Texas Criminal Justice System gives punishments that are deemed fit to the gravity of the crime, the death penalty is still too harsh of a crime. Prisoners are stripped off their Eighth Amendment rights when they go through the execution, which is an inhumane, cruel and unusual punishment. This can be examined through the methods that the criminal and justice systems and the method of execution.
When we think about prisons, jails, and courthouses, our minds are meant to draw a connection to cold, hard, justice and fair punishments for guilty and deserving parties. Yet, in our judicial and prison systems around the world, this idea is nowhere close to reality. From inhumane punishments, to mass incarceration, and “trapping” people in the system based on race or financial status, justice is far from being served.
The penal system in the United States is often portrayed as being tough on crime, but to many other western nations the penal system in the United States is viewed as a broken system (Mallory, 2006). While this is a tough critique, the American incarceration rate is the highest in the world at over 714 per 100,000 U.S. citizens (Walmsley, 2008). In Netherlands, Denmark and Sweden, (Doleschal, 1977) they believe that the treatment is better than the prison or death. For example, the Netherlands has “ 18 persons per 100,000 population, 1/12 of the U.S. rate of 215 per 100,000”(Doleschal, p.52) which is amazing if it did happen in America. The Texas judicial system has been called one of the most complex in the United States, if not the world. It features five layers of courts, several instances of overlapping jurisdiction, and a bifurcated appellate system at the top level. The structure of the system is laid out in Article 5 of the Texas Constitution.
With the population of the United States prisons growing every day we need to evaluate if they are doing any good. Personally, I believe that we need to keep our prison system, but we need to take steps in reforming them rather than abolish them altogether. The United States has the highest number of incarcerated people than any other country in the world. We must sit down and look at other countries and see what they are doing different than the United States. In this paper, we will first look at what the prison system in America is like and what we can do to improve upon our prison system. Then, we will also look at the Finland prison systems and see if we can learn anything from them, since they have one of the lowest incarceration and crime rate in the world. We will then look at reforming our prison system or abolishing it. Finally, we will investigate other punishment alternatives other than the prison system that we could use.
The criminal justice system is a set of agencies and processes established by governments to control crime and impose penalties on those who violate laws. Different jurisdictions have diverse laws, agencies, and ways of managing criminal justice processes. In recent years, it has been debated that the criminal justice system has two primary and possibility conflicting perspectives known as the retributive justice approach and the restorative justice approach. Retributive justice and restorative justice have contrasting approaches when imposing punishment, that will be explored within this research paper, in regards to the disadvantages and potential advantages resulting from the implementation of it’s polices within the criminal justice system. These two perspectives have been implemented amongst many different criminal justice systems internationally, however the questions still remain, what is justice? And how should justice be served? This debate has created a divide between countries, due to the differing interpretations of justice and it’s response to criminal activity. In prisons today, rehabilitation, deterrence, incapacitation, and retribution are all elements that provide a justice to society. Prisons effectively do their part in seeing that one if not more of these elements are met and successfully done. If it were not for these elements, than what would a prison be good for? It is highly debated upon whether or not these elements are done properly. It is a fact that these are and a fact that throughout the remainder of time these will be a successful part of prison life.
