Trail of Tears The Trail of Tears is a name given to the Cleansing and forced relocation of Native American nations from Southeastern parts of United States following the Indian Removal Act of 1830. The phrase originated from a description of removal of the Choctaw Nation in 1831. We Cherokee Indians have lived in our lands for centuries. The white setters forcefully came into our world and had an eye on our land to grow cotton and other crops. First they wanted to “civilize” us and “save our souls” by converting us to Christianity. Many of our people tried to comply, but they thought of us as alien people and looked down upon us. The Choctaw, the Chickasaw, the Cherokee, the Muscogee, and the Seminole (collectively called the Five Civilized Tribes) were living as autonomous nations in what could be called to the American Deep South. They initially started harassing us by stealing livestock, burning and looting our houses and squatting on our land which did not belong to them. The land they coveted was the east of Mississippi as this land was valuable for growing cotton. Several state governments passed laws limiting Native American sovereignty and rights, even though US Supreme Court affirmed our nation to be sovereign in the case of Worcester v. Georgia (1832). In the court case Worcester v. Georgia, the U.S. Supreme Court held in 1832 that the Cherokee Indians and Samuel Worcester created a nation holding distinct sovereign powers. This decision did not protect the Cherokees from being removed from their tribal birthplace in the Southeast.

In 1832, the Indians signed a treaty which stated that the federal government would provide them with suitable western land and would protect them until they moved. But, with the onslaught of white settlers, the War Department backed down on it’s promise (pbs.org). Also in 1833, a small faction of the Cherokee were tricked to sign an illegal removal treaty, also known as the “Treaty of New Echota.” Led by Chief John Ross, over 15,000 Cherokees signed a petition in protest of this new treaty, but the Supreme court ignores their demands and instead ratified the treaty in 1836 (pbs.org). The Cherokee tribe have lived what is now Northern Georgia for more than one hundred years. So it is claimed to be there land and therefore they have the right to stay and turn down the offer. Another argument is that the Cherokee had against the Americans is that there family, homes, and everything they know would have been taken away from them. Although the Americans have gave them fortune such as 70,000 square miles of land and millions of dollars if they leave. The Cherokee wasn’t aware of what awaits them if they did move to the new land.
On November 28, 1785 the Cherokee tribe signed the first peace treaty between themselves and the Americans; the treaty was named The Treaty of Hopewell. This said that the Cherokee land was, in fact, theirs and it couldn’t be taken from them. The Cherokee occupied the lands of present day Alabama, Georgia, North Carolina, Tennessee, and Florida. This treaty held its own for a few decades until Georgia decided that they wanted to deal with the “Indian problem” (Wing, Trail of Tears). Slowly, the people die from disease, starvation, and exposure to the elements as they walk for thousands of miles over a period of several months towards a land they know absolutely nothing about. All they can do is move forward, even as the people next to them die, because they are not allowed to go back to the land that was once freely theirs. The southern states were home to many Native Americans. This started controversy with the white settlers. The Indian Removal Act authorized the president to grant unsettled lands west of Mississippi in exchange for the Native Americans land. This forced Native American tribes to march their way west of Mississippi. Some tribes left in peace but most of the tribes resisted. The Trail of Tears is a tragic event that is still remembered today, just like the Holocaust in Germany. First of all, The Holocaust did not start out as the Holocaust. It started out as just being the hatred of Jews, but this ended up getting out of hand and many Jews were killed/murdered. The Jews were sent to concentration camps and had no choice of what they wanted to do. As, Adolf Hitler hated the Jews and wanted them killed. These same events happened in The Trail of Tears, The Trail of Tears started out as just the movement of The Cherokee to Oklahoma, but this soon changed. Many of The Cherokee ended up being killed or died. The Cherokee had absolutely no choice, they were to be forced out of their homes and sent to Oklahoma.
