The Center for Disease Control (CDC), is the main government body tracking, preventing, and evaluating the spread of risky and common diseases throughout the United States. In some cases, some diseases are not being reported by local and state governments making it hard for the CDC to track down the origin of the outbreak or behavior pattern of people involved. The authority requiring notification of cases or laboratories’ results referring to sexual transmitted diseases (STDs) such as Syphilis, HIV, or communicable diseases resides in the respective state legislatures. The primary goal of this mandates by the states is to identify the individual or individuals with symptoms of syphilis and interrupt the spread of the disease. However, there are some states that do not enforced the adherence to report cases of persons who acquired syphilis. Under Florida Statutes and Chapter 64D-3, Florida Administrative Code (FAC), practitioners, hospitals, medical facilities, schools, nursing homes, state institutions or other facilities providing health services are required to notify to the local county health department (CHD) and Florida Department of Health (DOH) within one business day results from syphilis suspected individuals. Laboratories are also required to report finding of Treponema pallidum, which is a causative agent of venereal and non-venereal syphilis as well as yaws. In the case of pregnant women and neonates, the notification needs to be immediately via telephone call to the DOH. The HIPAA Privacy Rule allows covered entities such as clinics, hospitals and private licensed practices to disclose PHI to public health authorities when required by federal, tribal, state, or local laws. This includes state statutes and rules that provide for reporting of disease such as syphilis, HIV, gonorrhea, and other STDs. However, Florida’s laws governing health information records for these types of diseases are more stringent than HIPAA and will preempt, or override, HIPAA rules. At UCCC, all patients should receive a Notice of Privacy Practices (NPP) when they register. The NPP explains to the patients how we use and disclosure of their information and provides instruction about how to make request for access to personal records. The patient has the rights to know how their PHI will be used, access to copies of medical records, who actually accesses it, request more confidentially while communicating with other entities regarding his or her health condition, and file a complaint if she or he feels that their HIPPA rules have not being
