Bona fide occupational qualification and the military
Title VII of the 1964 civil rights act prohibits employment discrimination based on race, color, religion, sex and national origin. Contrary to title VII, gender and religion under the bona fide occupational qualification allows discrimination for certain jobs that calls for a particular group, age limit etc. An example of a company using bona fide occupational qualification in the United States Military. Every day bona fide occupational qualification is used in the United States military to decline thousands of applicants daily because of their age. The age limit for joining the navy is 34 for active duty and 39 for applicants attempting to join the reserves. The argument against women serving in the elite navy seal units is that women are not able to meet the physical standards that are required by the Special Forces. Reports in basic training has shown that women are able to meet and exceed the swimming, running and push-ups when they are placed in advanced divisions. A second argument that is made is that the price tag to send women to Basic Underwater Demolition School or buds, would cost millions of dollars a year. The answer to this argument is to change the training pipeline to mirror the men. Before any male is sent to Buds, they must pass pre-buds in basic training. If the trainee doesn’t pass pre-buds they are reassigned into another job or discharged from active duty. Women have served in combat roles for the last 25 years, including the wars in Iraq and Afghanistan. Now it’s time to give them the opportunity to serve as navy seals by striking down outdates restrictions and perceptions of women
Angelo is a 65-year-old male who has left-sided hemiparesis because of a right cerebrovascular accident that occurred 7 years ago. Though he has left upper extremity weakness, it does not affect his right upper extremity, which is his dominant side. The military has always been something of a “man’s world”, where men were on the front lines, and running the show, and if a female were present she would be seen in a nurses uniform. This paper will discuss the U.S. Army’s decision to allow women into combat Military Occupational Specialty (MOS), specifically into MOS 12B known as a Combat Engineer which for years has been closed to women. Now there is a move under way for full female equality in the fighting forces. One quarter of U.S. Navy jobs are still off limits to women still today. On April 28, 1993 Secretary of Defense Les Aspin announced a policy to open up nurse specialists and assignments to women in the armed forces. The policy means that women will no longer be excluded from military specialists simpily because the jobs are dangerous. It opened up combat aircraft to women. It instructed the Navy to open additional ships to women. In November Congress signed legislation repealing the law barring women from serving on combat ships.
Women and war have always been considered to have little in common. As the gentle sex, women are traditionally associated with the care and creation of life rather than with its destruction. However, over the past twenty years, women have increasingly served, and continue to serve, with valor and integrity in the Unites States Armed Forces (Kamarack, 2015). Although women have successfully proved themselves in the military, they should be restricted from entering into direct combat because they are less physically fit than their male counterparts, create animosity on front lines, and undermine cohesion within a military unit.
The Bona Fide Occupational Qualification (BFOQ) is contained in Title VII of the Civil Rights Act of 1964. Under this title, employment in particular jobs may not be limited to individuals of a particular sex, religion, or national origin unless the employer can show that one of these factors is an actual and necessary qualification for performing the job. BFOQ is usually decided on a case-by-case basis. Race is never a BFOQ. When BFOQ is used as a defense, the employer admits sex discrimination but under the terms of the statute it is justified (Sovereign, p.91). The Supreme Court has determined that the BFOQ exception is intended as a narrow exception to the prohibition of sex-based discrimination (Hawke, p.58).
For years women have been trying to gain gender equality throughout the working world, along with in the military. Since the beginning of a uniformed military, women could not serve in military occupational specialty (MOS) positions that put them in direct combat roles. Although many women have contributed in significant ways, they have not been authorized to serve in MOS such as infantry, artillery, or armor. As the war on terrorism has developed since 9/11, women have slowly worked their way farther into the military and its many roles. This resulted in women being placed into direct combat roles. Though women have been allowed into many different roles, there is still one battle that they have yet to win and this time the majority is not backing them. Women are trying to gain access to United States Special Operations units in every branch of the military and the majority of these operators are not happy about it. After years of discussion and debate it appears that soon women will be sent into combat operations in the United States military. This is the way it should be because women are ready and competent to be put into combat roles in the U.S. military. Indeed, slowly but surely, the Defense Department and Congress have been inching towards a decision that will formalize the policy; in fact the National Defense Authorization Act, put before Congress in May, 2012 by U.S. Senators John McCain and Carl Levin will in effect order the military "…to come up with a plan to send women into battle" (McAuliff, 2012). Hopes are high that this will be approved by Congress and signed into law by President Barack Obama.
Women have fought alongside men in the United States Military in every major battle since the American Revolution. The roles of women in the military have evolved over time to allow the incorporation of women in expanding military career fields. Women have proven themselves to be an asset to the military despite some of society believing women would weaken America’s military effectiveness. Today more than 200,000 women are active-duty military, this is about 14.5% of all military. When it comes to combat assignments and the needs of the military, men take precedence over all other considerations, including career prospects of female service members. Female military members have been encouraged to pursue opportunities and career enhancement within the armed forces, which limit them only to the needs and good of the service due to women being not as “similarly situated” as their male counterparts when it comes to strength or aggressiveness, and are not able to handle combat situations.
