Introduction
As the owner of Acme Fireworks you have asked me, you manager, to review and explain some ideas to you. In the following pages I have explained the potential personal liability for injuries to consumers and what must be on our labels for safety. Analyzed the newly formed contracts with the retailers and the employment and expansion that are needed for Acme to go along with the new contracts, and then concluding with the change of the business entity. If Event Palace needs a quick shipment or a special order of $300 or more Acme would need to have that item in stock or they would need to add it to the next order, or pay additional prices for rush delivery.
If an unforeseen and/or uncontrollable event happens to either party, they may have the option to back out of the contract, for a negotiated period of time, for repairs or termination of the contract, if necessary. Conditions such as but not limited, but not limited to, weather conditions, store, warehouse, or personal property damage. Chose to go back through a couple companies that I used to work for. I chose Subway, Main St. Liquor, and Taco Bell. The Home Depot (THD) is the second largest retailer (besides Wal-Mart), and the largest home improvement store in the world (THD, 2012). The company has not had any need to recruit employees in the past, but recently they have had an issue fielding applications for qualified personnel to work in their kitchen planning departments inside the stores. The issue is not that there are no willing people to fill the spots, but that THD has been unsuccessful finding people who have the qualifications to fill the positions. Associates can be recruited from other areas of a store, but the training process is extensive and expensive, so the company is looking for means to fill the positions with more qualified individuals. Thus, the training process would be shorter and less expensive, so the employee would be in the position quickly. This paper outlines a recruitment plan for the position.
Various liabilities can arise while manufacturing and selling fireworks. Potential personal liabilities can also arise if a customer is injured while using the fireworks and can often be devastating to the owner of a business, especially if the owner is not protected by an appropriate business structure/entity (Rogers, 2012). Hence, in order to expand the business, one of the best precautions would be to change the business from a sole proprietorship to a Limited Liability Company (LLC) (Miller, 2015). Moreover, while transitioning into a larger business, the company would have to hire additional employees or independent contractors so as to keep up with an increase in demand for the products, which leads to the necessity of having a valid contract in place to ensure that every transaction and business dealing is carried out legally (Miller, 2015). Hence, the purpose of this paper will be to provide advice to Acme Fireworks’ owner as the manager on different issues ranging from common law and UCC requirements of business contracts, the essential elements of a contract, personal potential liability in case of injury, the different types of employment and the most appropriate business structure for the company.

Use creative recruiting sources to target that individual including social media as an outlet to find top talent. An interview process that allows you the company and the candidate to learn as much about each other is important to making sure it is a good fit.
