Actus Reus
Introduction
The Criminal Law of England and Wales "means the portion of the law of England and Wales, which deals with the components and consequences of criminal acts. The English criminal law is in large part not regulated by law, but in the tradition of common law judge-made law. The offense consists in the English law of Actus Reus and mens rea together.
Actus Reus is the Latin term meaning the act of guilt (the outer or objective of a criminal offense). This is an essential element in the determination of a crime. A person can be charged with a crime for not acting, if there is a legal duty to act. For example, parents have a duty to protect their children from harm. If they fail to take reasonable steps to protect their children, a reckless omission to act could result in criminal charges. Parents who failed to feed their children could be prosecuted for child neglect. The duty to act is usually defined in criminal statutes. Thus, the deliberate failure to file a federal income tax return violates the criminal provisions of the Internal Revenue Code. Conversely, if there is no legal duty to act, the failure to do so is not a crime. For example, the failure to rescue a drowning stranger does not meet the Actus Reus requirement.
Actus Reus in Criminal Law
This principle has been restricted by many exceptions: Failure leads to criminality about it, if the statute law is merely said that a success "caused" to be. But also in the field of law is not fixed common-law -crime several exceptions are discussed:
Continuo (act, continuous action '): In case of Fagan v Metropolitan Police Comr (1969) continued the defendant (hereinafter D) on the foot of a police officer by mistake. Actus Reus Non Facit Reum Nisi Mens Sit Rea: An act does not make a person guilty unless the mind is also guilty. In the case of R. v. Pickton (2010), the Supreme Court of Canada convicts serial killer Robert Pickton of second degree murder and demonstrates that even if an individual was not the sole perpetrator of a crime, they are still held equally liable for the crime as long as they are an active participant or otherwise abetted the misconduct. The Supreme Courts made the correct decision in dismissing Pickton’s appeal.

Referring back to murder the defendant could have unlawfully kill someone if they had a bad intention but if the defendant did it for self defence then it is not classed as unlawful. An abstains from doing so in order that B may be drowned. A has committed no offence” an omission is only agreeable for the Actus Reus, where there is a duty to act. The English law were based on the common law or the case laws which were developed by judges during the course of various court decisions. Common law derived when judges in court applied legal precedent to the various cases before them to come out with judgements.
