Racial and cultural discrimination has over time diminished extensively. There are still struggles with the ethnic disparities in the judicial system. Research has shown that there are still some discrimination in some of the stages of the processing of the judicial system, and that it occurs sometimes, in some areas. The treatment in the judicial system often occurs, which causes some of this discrimination due to the treatment and results in racial outcomes that are much larger of an issue than research has found. It is often noted that some of the minorities are involved in crime at a much higher rate than ever imagined. The amount of victimization in youth have risen over the years. The amount of drug arrests and incarceration for the punishment have increased combined, which has affected the minority youth in a particularly severed manner. The rates for arrests of juveniles of the white background has decreased but in turn the rate has increased for those with black background. Research has shown that the law enforcement officers were more prone to have higher surveillance in the low income communities over other areas. They were stereotyped as the low income communities be for those of higher crime rates and the ethical background was more likely to be those of drug users and others prone to commit crimes. Those in the low income were more prone to be arrested and it was often more so for the black juveniles over any other race. Research showed in the past that when there was violence it was typically caused by the deeply abrasive and hostile relationships interacting between law enforcement and minorities. The research showed that there needed to be changes in law enforcement reform. The law enforcement has since offered higher education, expanding police programs and offering more minorities and women into the program, to maybe help the connection between the two groups get better and stronger. This would help the relationship and the communication with the
community and law enforcement. When this occurs, the community feels more secure with the law enforcement and they are willing to work with them much better. The understanding between the two groups builds much stronger relationships and promotes less criminal activity. There is still a huge issue with the aggressiveness of the police force. Many officers are too aggressive and their force is stronger than it ever should be. This is more apparent with certain minorities and the suspect’s race is often a factor into which offender the police officer will be more aggressive with. This should not ever be a factor and come into account when arresting someone. It is often still based on stereotypes and past experiences. Racial profiling is widely associated with the way police officers decide in which race they will pursue in specific arrests or stops. Discretionary decision making based on stereotypes (race, ethnicity, or gender) has long been in use by police (Race, Ethnicity, and the Criminal Justice System, Pg 14). The courts and legislators have given law enforcement more power to make judgments in who to stop, arrest or even search. Although the public feel that the criteria for arrests, searches and stops should not be based on race in any manner. The research has not been able to show as to whether the police are engaging themselves in illegal or inappropriate profiling of racial backgrounds in those offenders they arrest, search or stop. There needs to be more research done in order to find the accurate information for this. There is strong evidence that racial discrimination exists in the capital sentencing process of many states. (Race, Ethnicity, and the Criminal Justice System, Pg 20). Many studies still find that there is evidence of discrimination in the judicial system of the criminal area. It can be both direct or overt whenever you look at the research and what it is based on.
