Sam Rinaldi Music Publishing – Week 10 21 November 2022 1. What is sampling? a. Sampling is the interpolation of existing copyrights into new ones. 2. What do pitching/placement companies do? a. Pitching/placement companies represent artists, songwriters, and small indie labels for purposes of getting their music used in movies, TV shows, commercials, computer games, and elsewhere. 3. What is a potential issue regarding sampling? a. A potential issue regarding sampling is if your song is unique enough. If an artist wants to sample part of a song, there is a question of if that song is liable to copyright protection. 4. Can you name for me a lawsuit regarding copyright infringement via sampling, and what are the details of the case: who is involved, what song(s), what is the reason for the lawsuit? Who won (if applicable) (besides the "blurred lines" case) a. Lana Del Rey vs. Radiohead. Lawyers representing the music publishers for Radiohead claimed that Lana Del Rey used the same chord progression and other musical elements from “Creep” in her song “Get Free.” While it never went to trial, Lana Del Rey claimed that they settled, though no settlement has been announced. Interestingly, Radiohead had been sued by another band over “Creep” and they also settled out of court. 5. Find, if possible, the samples used in: a. "Break My Soul" by Beyonce i. Show Me Love by Robin S. ii. Explode by Big Freedia b. "I'm Good (Blue)" by David Guetta & Bebe Rexha i. Blue (Da Ba Dee) by Eiffel 65 c. "WAIT FOR U" by Future Featuring Drake & Tems i. Higher (Live) by Tems 6. What are some of the terms in an agreement with a pitching/placement company? a. Exclusive vs Non-Exclusive Grant: most companies want to have the exclusive right to pitch/place your music. Granting that right to multiple companies can be confusing, and this process should be as simple as possible. b. Term of the Agreement: 2-3 years is typical for most pitching companies. In most case, the term will auto-renew for an
additional 1-year periods unless proper notice is given (and those details will be indicated in the deal.) c. Music Covered: both the composition and master are included in the agreement. 7. What can ruin a relationship between a placement company and a music supervisor? a. A placement company may send music directly to a music supervisor for a project they’re working on. With this method, the relationships involved are the utmost importance- the employees of the production company reviews the music to see what will work. However, if a company continuously sends music that doesn’t make sense/doesn’t work for what was requested, the music supervisor will no longer use that company for music because you are playing in their face.
