Do you think the person or institution intended to break the law?
I do not think that the person intended to break the law. In the end, it wasn't right.
There are laws for certain reasons in this case the daughter could have been a
stranger and that is very dangerous because the person wouldn't have known. HIPPA
is there for a reason
Do you think the punishment and/or fine is fair?
I do think it's fair because the person did break the law and they have to suffer the
consequences even if they didn't mean to break the law. Laws are laws for reasons if
I were the patient I would want the person to get fined even if it was to my daughter,
you never know, maybe the patient didn't want anyone to know their medical
information, for reasons maybe the patient had cancer and didn't want that news out
just yet, maybe the patient had news to process.
Do you think patients were harmed in this case?
I do not think the patient was harmed in the case, the information was given to their
daughter and I don't think the daughter had any bad intentions with that information.
Along the lines of the law the patient was technically harmed due to the patient's
personal/ confidential information was shared over the phone
If you worked with this person or for this institution, do you think you would have
noticed the problem?
I think I would have I honestly don't see a problem with sharing information with a
family member, but there are laws, and patients' information is private, and delivering
private information over the phone, even to family members, is wrong. I believe there
could have been a different path this case could have taken. For example, the person
could have contacted the patient and asked if she wanted the information shared
with their daughter, and if they did, they may have needed to deliver the information
themselves because I am not sure that even with the patient's consent, they could
still share the patient's information with others.
