Module 4 Critical Thinking Questions a. Briefly summarize the origin and intent of the American Bar Association. The ABA, established in 1878 in New York, is dedicated to promoting the rule of law in the United States and internationally. It achieves this by offering practical tools for legal practitioners, accrediting law schools, and developing model ethical codes, among other initiatives. The ABA inspired growth of both local and state bar associations, and by 1925, there was an organization of lawyers in every state and territory. b. Compare and contrast lawyers who practice law in large corporate firms and government lawyers. Corporate attorneys handle the rules, regulations, and laws that govern the establishment and operation of corporations, while a government attorney may work for the municipal, state, or federal government in roles such as state attorney or public defender. They must study their client's case, understand and apply applicable laws, and argue their case in court. They both argue cases, handle legal proceedings, and manage case files. The job aspect for both legal professions are relatively the same just different corporations. c. How did Christopher Columbus Langdell revolutionize the teaching of law? Langdell's most significant innovation was his development of the case method of instruction. Until 1890, no other law school in the United States adopted this system, which is now considered standard. He implemented improvements that other schools followed and that are still in effect today. These reforms included tight entrance standards, the adoption of a three-year program, students having to pass end-of-year tests to advance to the next year, the introduction of case teaching techniques, and the employment of a Socratic way of teaching. d. Briefly summarize the early years of African American lawyers. The first African American male lawyers were granted admission to the Massachusetts bar in the mid-1840s. The first female African American lawyer was granted permission to practice in the District of Columbia in 1872, following her graduation from Howard University. The South has the most severe impediments to African American law school entrance and discrimination within the legal profession. They campaigned for years against social justice inequalities, which they continue to fight in some cases now. The
ABA did not admit African American lawyers as members until 1943. The progress of all minority lawyers has been modest. e. Explain the findings on professional satisfaction in the legal profession. According to research, lawyers report high levels of satisfaction; nevertheless, some circumstances, such as work environment, experience level, and pay, might have an impact on satisfaction. Rookie attorneys may express less satisfaction than more seasoned lawyers. Relationships play an important influence on satisfaction. According to research, long-term pleasure is dependent on relationships, particularly those with coworkers, supervisors, and the community. According to research, stressing psychological characteristics such as autonomy, authenticity, and competence might improve the well- being of attorneys.
