Reducing Incarceration Rates Essay

Ever since the first prison opened in the United States in 1790, incarceration has been the center of the nations criminal justice system. Over this 200 year period many creative alternatives to incarceration have been tried, and many at a much lower cost than imprisonment. It wasn’t until the late 1980’s when our criminal justice systems across the country began experiencing a problem with overcrowding of facilities. This problem forced lawmakers to develop new options for sentencing criminal offenders.

By the lack of rehabilitation programs in the state and federal prison systems, the chances of convicts releasing and returning back to prison increases rapidly. The lack of rehabilitation is one of the most leading causes to an offenders relapse or to a new crime that will be committed within 3 years from the offender’s release. A rehabilitation program

Every civilization in history has had rules, and citizens who break them. To this day governments struggle to figure out the best way to deal with their criminals in ways that help both society and those that commit the crimes. Imprisonment has historically been the popular solution. However, there are many instances in which people are sent to prison that would be better served for community service, rehab, or some other form of punishment. Prison affects more than just the prisoner; the families, friends, employers, and communities of the incarcerated also pay a price. Prison as a punishment has its pros and cons; although it may be necessary for some, it can be harmful for those who would be better suited for alternative means

Over the past few decades, the United States has witnessed a huge surge in the number of individuals in jail and in prison. Evidence suggests the mass imprisonment policy from the last 40 years was a horrible catastrophe. Putting more people in prison not only ruined lives, it disrupted families, prevented ex-prisoners to find housing, to get an education, or even a good job. Regrettably, the United States has a higher percent of its population incarcerated than any other country. America is responsible for a quarter of the world’s inmates, and its incarceration rate is increasing exponentially. The expense produced by these overcrowded prisons cost the country a substantial amount of money every year. Although people are incarcerated for a number of reasons, the country’s prisons are focused on punishment rather than reform, and the result is a misguided system that fails to rehabilitate criminals or discourage crime. By researching mass incarceration, I hope to get society to understand that incarcerating an individual not only effects the family, but we will look at the long term consequences on society and how the United States can remain safe and, at the same time, undo much of the damage that results from large-scale imprisonment.

The United States of America is phrased by many, as being “the land of the free.” Yet, the Unites States currently has the highest per capita prison population than any other country. The United States makes up only 5% of the world’s population and of that 5%, 25% of our overall nation’s population is currently incarcerated. A few factors that attribute to our high rates of incarceration include, sentencing laws: such as mandatory- minimum sentencing, lack of initial deterrence from crime, the war on drugs and the presence of recidivism. With our ever growing incarceration rates and the cost of housing individual offenders averaging $22,000 a criminal justice agenda. Recidivism refers to a person 's relapse into criminal behavior resulting in rearrests, reconviction or return to prison with or without a new sentence during a three-year period following the prisoner 's release (National Institute of Justice.) Many programs have been implemented in our prison system to help reduce the recidivism rates. Programs such as educational/ vocational programming, reentry programs, substance abuse programs and subsidized employment are among many programs in which have been proven effective. Yet, due to costs deficits, the clock is ticking to find evidence based programs to invest in. So, the question currently being sought after is, which method is most effective in reducing recidivism rates?

Longer sentences has been a major cause of mass incarceration. Thus, changing how governments respond to all crime, not just drug crime, is critical to reducing the size of prison

Mass incarceration is a major problem in the United States. Since the tough on crime movement that began to emphasize more punishment and creating new policies such as; three strikes law, truth-in sentencing laws, mandatory sentencing, and determinate sentencing, our prisons and jails have become overcrowded. The three strikes law increases the prison sentence of an offender convicted of three felonies or serious crime. Usually the punishment ranges from a minimum of 25 years to life in prison. The truth-in sentencing laws require the offender to serve a substantial amount of their prison sentence (usually around 85 percent) before they are eligible for release on parole. The mandatory sentencing requires a minimum period of incarceration that the offender must serve regardless of the history of the offender or the nature of the circumstance. These get tough policies have implicated longer prison and jail sentences and has reduced the amount of discretion that the judges, parole/probation officers and prison and jail administrators. These actions have consequently increased the prison and jail population, which causes an increase in money spent on jails and prisons.

The nations prison system must be changed because of major problems with the system such as overcrowding and the fact that early release programs do not work. Building more jails is expensive and does not solve anything. These problems can be solved by giving prisoners no chance for parole

In the past four decades, there has been a staggering increase in the United States prison population at the local and state level. Currently there are 2.2 million people in the nation’s prisons and jails that has added up to a 500% increase over 40 years (The sentencing project). The cause of this prison growth is a variety of laws and punitive sentencing policies that were initiated starting in the early 1970’s. Policies such as harsh drug penalties for non-violent crimes, Mandatory Minimum Maximum sentences and the Three Strikes law have all contributed to America’s current problem of mass incarceration.

Mass incarceration is a problem around the world, but nowhere else is it more plague than the United States of America, which has one-fourth of its population locked up behind bars. The cause for this problem in the U.S. can be blamed on many things, the "war on drug", private prison facility, tough laws, and mandatory sentencing. However, there are programs that are in place to help reduce the number of individuals in prison, like the "Texas experiment (Justice reinvestment)", and other rehabilitation programs. But those efforts alone cant fix the problem. To decrease the mass incarceration in the U.S. a new approach must be taken, such as; eliminate prison time for low-level crimes, "the three-strike law”, expand parole and probation, and reform private prison.

Because the attitude toward crime has diminished in volatility, it can now be brought into question whether incarceration is really effectual or cost-effective. While funding is required to build up these rehabilitation programs, in some programs the savings cannot be clearly understood until a few years into the revision.

The prisons in America seem to cause more problems than assistance in today's society. The country's penal system is overcrowded, expensive, and some argue that is ineffective as well as inefficient. The costs to staff and support these facilities increase dramatically every year. Prisons, which are supposed to be correctional facilities, are currently filled with violence and hostility. These institutions are created to control crime by deterrence, incapacitating criminals, which protects society from potentially dangerous criminals, but it is hard to tell if this is being accomplished.

The United States prison population has expanded at an increasingly rapid rate over that past several decades. Each day, more and more criminal offenders are sent to prisons; most of which were designed to house fewer inmates but are now packed to their limits. This “mass- incarceration era” as many scholars and commentators of the Criminal Justice System call it, is a result of several key issues that have created an environment within the correctional system that forces many inmates to serve longer prison sentences while increasing recidivism rates. Current federal and state sentencing policies have resulted in historically high rates of offender recidivism and the highest incarceration rates in the world (Warren, 2007). As a result, prison population and overcrowding has rapidly increased and has become a serious issue across the country however, a reform in sentencing policies, more early-release incentives, and reintegration back into society through rehabilitation will help reduce recidivism and prevent the continuing rise of prison populations. Currently as a nation we use severity as our biggest form of deterrence; our threat of imprisonment has grown dramatically over time. In 1985 the average release time for a conviction of robbery was 32 months and in 2002 it jumped to a minimum of 53 months (Incarceration and Crime). We focus heavily on severity and longer incarceration rates; the idea is that a 10% increase in incarceration would lead to a 1.6%-5.5% decrease in crime (Lieka 2006) but this is not true. Prison rates have increased tenfold since 1970 and yet the crime rates have not dropped near those percents.The leading argument against increase in incarceration uses other states as examples of how ineffective it is; for example Florida heavily focuses on imprisonment to reduce crime with no effect (Incarceration and Crime). This idea would be great and a good mode of deterrence if those who go to prison actually learn their lessons and mend their future ways. Also if the unwanted effects of prison were at least tolerable this might deter crime but sadly even after experiment and evidence it is not a well functioning theory. The cost of funding our mass incarceration does balance out the decrease in overall crime. Besides when we have a nation who is majority hard on crimes compared to other crimes we end up severely punishing people who probably would respond better to rehabilitation than jail.

Over population in prisons are becoming a frequent problem. High crime rates and stricter law are causes a mass incarnation level. Due to budget cuts Ohio is letting 6,000 convicted felons out early. Prisoners with low-level drug offences are eligible for early releasement. These criminals will be released to half-way houses. There they will be monitored by probation officers who will help them reenter society. This was a new idea presented by the prison chief Gary Mohr. He presented a new budget to the Ohioan government with the idea to spend less money on prisons and more money towards rehabilitation programs. Chief Morh’s argumentative point was, “Do we invest in people or in bricks and mortar? To build and operate one prison for two decades would cost Ohioans one billion dollars”. Keeping jails operating is a hefty expenses. A study by Public Safety Performance Project of the Pew Charitable Trusts showed that Ohio’s crime rate dropped 23% in 1993 -2012 but surprisingly incarceration rate rose 17%. Hopes for the rerelease is to save the state tax payers money, as well as, to fix a broken system. I believe that the Nixon’s war on drugs campaign, produced inefficient drug laws and taxpayer money should be spent on rehabilitation programs rather than building brink and morters.
