On July 1, 2003, California enacted an electronic data privacy law to protect residents from one of its fastest growing crimes: identity theft. SB 1386 (Civil Code 1798.29) requires businesses to notify California residents if a security breach results in disclosure of personal electronic data. All businesses are subject to this law regardless of size, location, or operations. Business owners should be aware of the problems associated with identity theft, the steps required to comply with SB 1386, and the preventative measures available.

California’s SB 1386 takes the FTC’s efforts one step further by requiring companies to notify California residents when a security lapse has resulted in disclosure of personal information so that immediate action may be taken to mitigate damages. In 2002, the California state employee payroll database was breached. Confidential information about 265,000 employees was available to hackers including names, addresses, bank account numbers, and social security numbers. The data center didn’t notify anyone for several weeks, leaving the employees vulnerable to identity theft longer than necessary. In response, SB 1386 was enacted as a means to ensure that Californians receive prompt notification so they may take immediate steps to protect their personal information.
SB 1386 applies to any business that stores unencrypted personal information of an employee or customer that resides in California. According to the law, personal information means an individual’s name in combination with any one or more of the following elements:
1. Social security number
2. Driver’s License number of California Identification Card number
3. Account number, Credit or debit card number, in combination with any required security code, access code, or password that would permit access to an individual’s financial
Identity theft is a major concern today in our country, millions of a person’s identity have been compromised for many of years. Identity theft occurs when someone uses another person’s personal information such as name, Social Security number, driver’s license number, credit card number, or other identifying information to take on that person’s identity in order to commit fraud or other crimes. Stealing an identity is, unfortunately, surprisingly easy to do and happens when you least expect it. Just by opening your mail, something that has personal information on it, throwing it in the trash. Therefore, a person can go through your trash and take all that information and use it against you to take on a new identity.

The FTC estimates that each year, over 9 million people are affected by identity theft. According to Sally Driscoll, this is because almost anyone with a computer and a slight bit of computer knowledge can pull off identity theft. Experts also claim that identity theft is the fastest-growing crime in the world. Identity theft is a global problem that cannot be stopped without effective measures. The problem is, effective measures are very hard to come by when dealing with identity theft because almost any security protocol can be by-passed.
During the last Christmas season, Target announced that their data security was breached. According to David Lazarus in Los Angeles Times, Target stated that roughly 110 million customers’ information was illegally taken from their database. The information included their credit/debit card info, phone numbers, and email addresses. Target is one of the most popular grocery stores in the U.S.; they have a substantial amount of consumers. Because of this incident, consumers' trusts for the store have been decreasing. Worrying about losing its customers, the company offered a free year of credit monitoring and identity-theft protection, so the customers will feel more secure. Not only Target, some other large retailers also faced the same issues. They want their customers to trust that the companies can protect private data. However, should we not worry? Data breaches have been going on for about a decade, but we have not seriously thought about the issue. In order to protect people’s privacy, the federal government should make new laws concerning companies’ handling of customer information.

Identity theft is a negative issue in the entire United States, but the state of Florida is where it is most common and where there is the most cases. Due to Florida having the most identity theft complaints, it is important to question just how vulnerable the state is to this form of fraud. However, it is evident that Florida needs to find more efficient ways to limit identity theft drastically, since it has led the nation in identity theft for the past three years.
