III. Guidelines A. State and Federal Laws In the field of human services, every professional is expected to follow the laws that are in place both at a state and federal level. These laws are in place to make sure children are remaining safe in all aspects. The case I am currently analyzing revolves around the issues of abuse and neglect. The Child Abuse Prevention and Treatment Act (CAPTA), was passed in 1974, and establishes national definitions regarding child abuse and neglect and assigns certain responsibilities to the federal government, particularly relating to data collections and technical assistance (CAPTA, 2023). There are a number of child welfare-related laws that CAPTA have supported and established including the Victims of Child Abuse Act of 2018, Child and Family Services Improvemnt and Innovation Act of 2011, Keeping Children and Families Safe Act of 2003, and the Child Abuse Prevention and Treatment Amendments of 1996 (ACF, 2023). All of these laws are in place to protect children, prevent any form of abuse on children, and protect the rights of families as well. These laws relate to Amy’s case because unfortunately, the children were abused, neglected, and in result, removed from their home. The children were removed from the home because of the laws and regulations that are in place to help protect children from abuse. The safety and rights of children are always the main focus, whatever their age, all children have human rights just as adults do. This includes the right to speak out and express opinions, as well as rights to equality, health, education, a clean environment, a safe place to live and protection from all kinds of harm (Amnesty, 2021). As it pertains to this case, we take note that children have the right to a safe place to live and protection from all kinds of harm. As a whole, the family has rights to remain
a family so there are laws in place to help keep them together or reunite families like the Child Welfare Act of 1980 (ACF, 2023). However, families can have their rights stripped when a child's safety is at risk. B. Ethical Principles When human professionals intertect with families such as this, it is important that they communicate and treat the family adhering to the ethical principles for human service professionals. The 4 main ethical principles are beneficence, nonmaleficence, autonomy, and justice The ethical principles that relate to this specific case are essentially about avoiding any harm to the children while also helping Amy gain control of her life. The ethical principles for social workers include honesty, integrity, following all laws, adherence to employer policies, and procedures (UB, 2022). These principles inform the practitioner that they must remain honest and gain the trust of their client to fully be able to assist them. IV. Best Practices A. There are many human service practices that relate to this specific issue. One of the issues to consider is Amy and her state of mind and health. She has a past with addiction and abusive relationships. People with substance use disorders are up to 3 times more likely to have a mental illness (CAMH, 2022). An abusive relationship can leave someone with intrusive thoughts, flashbacks, and nightmares, which can be symptoms of PTSD. Abuse can also result in emotional numbing, social isolation, and panic (McLean, 2023). The best human service practice for this particular issue would be Cognitive Behavioral Therapy (CBT). CBT helps one to challenge and overcome automatic beliefs, and use practical strategies to change or modify your behavior. The result is more
