Coming from the small town of Burlington, nothing really happens especially when relating to fraud; or so I thought. Before this class began I never realized how much fraud occurs until starting this project. Being a Criminal Justice Major at Salem State, I constantly think of crime and I recall in my Criminal Justice Class, CRJ 250 Theories of Crime, my professor did an exercise that really impacted the way I think about crime. She made us all write down a crime we can think of, anything. Then we listed it and many crimes repeated, such as rape, assault, and drug usage. And out of every single person, not one person said white collar crimes. The news does not give white collar crimes any attention because in truth, it is not as “view worthy” …show more content…
The first mistake Foss did was titling his business. In order to avoid the premium for paying for extra insurance, Foss titled himself as a contractor instead of a roofing business (Gallagher). This in result made it so Foss did not have to pay as much to cover his employees. Realistically, insurance companies tend to cover more risk worthy jobs, but it cost more money to cover it; and Foss knew that. Foss lied and misinterpreted the nature of his business. According to Agency Checklist, “Mr. Foss misrepresented the nature of his business on an application for insurance through the Massachusetts Workers’ Compensation Assigned Risk Pool. Based on this misrepresentation, the WCRIB did not classify Mr. Foss’ policy properly as a roofing risk and Mr. Foss paid $120,000 less in workers’ compensation premiums than he would have been paid, if the policies had been properly classified at the higher correct premium… On Mr. Foss’ company’s website, Bob Foss Contracting, the company states that it is a “General Contractor in the Greater Boston …show more content…
By putting the wrong insurance for all of his workers, he put every single one of them in danger. This took place in 2009-2012 where Foss defrauded two insurance companies under three separate insurance policies including the one local to me, Burlington. The background of Robert Foss is pretty confidential especially because his company was not the biggest company. This was also not the biggest story that people were very concerned with. Robert Foss never talked to the media regarding his standing either. On his website, Robert’s “About Us” section is written in third person and talks about how he developed his business to what it is now 30 years later. It is now a family owned business and it is clearly evident whoever made this page was not attempting to hide anything. Something that took me by surprise was on the about me section, there is another sub-section that is titled “Questions you should ask your builder”. It was weird to me because I feel like you would not see that on many people’s website. There were no answers either. It was almost similar to a do it yourself evaluation to your builder. If I was the owner, instead of asking the questions about them, maybe for more security, show a picture of the builder and ask the questions with the answers underneath them. This way it is more trusted and people will not have any more
White-collar crimes are just as prevalent today as ordinary street crimes. Studies show that criminal acts committed by white-collar criminals continue to increase due to unforeseen opportunities presented in the corporate world, but these crimes are often overlooked or minimally publicized in reference to criminal acts on the street. Many street crimes are viewed as unnecessary, horrendous crimes because they are committed by lower class citizens, whereas white collar crimes are illegal acts committed by seemingly respectable people whose occupational roles are considered successful and often admired by many (Piquero, 2014). These views often allow white collar crimes to “slip through the cracks” and carry lesser charges or punishment.
Throughout history, many academics have proposed various theories to help comprehend and explain criminal behaviours. These theories investigate many different aspects of the causations of crime and those at risk of criminal behaviour. White collar crime is a term founded less than a century ago within 1939 by Edwin Sutherland. He identified white collar crime as "crime committed by a person of respectability and high social status in the course of his occupation" (Hirschi, 1987, pg 953). Sutherland strived to explain all types of crimes. He proposed that crime occurred beyond the streets, within the business and politic realm. White collar crimes differ heavily from street crime, as they are nonviolent acts committed by those in a state
Welcome to the age of white collar crime. A time when the words thieves and businessmen go hand in hand. White collar criminals don’t get their hands dirty in their work. They use their heads to get what they want instead of using a little muscle. These criminals are just as dangerous as the rapists and murderers. In these times, even the most seemingly respectable people are suspected of white collar crimes.
In 1939, American sociologist Edwin Sutherland introduced the phrase “white-collar crime”. White-collar crime is a nonviolent crime committed by a business or large corporations. They are usually scams or frauds to gain wealth in society. The people who are guilty of this crime lie, cheat and steal from investors of their company or business. Even though these crimes are non-violent, they have major impacts on the society. Their companies become non existent and families get destroyed. All of their life savings and savings for their children get taken away, and they become bankrupt. Not only does it affect their families, the investors who believed in their business lose millions or even billions of dollars.
In this assignment, you will examine the various criminal theories that were discussed in the reading. In a page or two, explain which theories best explain white collar crime.
To follow-up on our conversation about Marty Anderson, he called me on Monday to advise us that he has been working on getting our firm on the Chubb liability approve list. He told me that Steve Bradley, the large loss adjuster on the Cutaia case that we have been handling, was very pleased with our handling of that high level matter, legal analysis and recommendation. I can tell you that the analysis was extensive, involving the law of three separate states. This involved a coverage question involving Mr. Cutaia’s property. Mr. Cutaia is a billionaire. One of his properties is located outside of Charlottesville. He had an underground bunker constructed. There were construction defects in the construction which led to the collapse
These people have more opportunities to commit a white collar crime than a person with little authority. Peter Michelmore, a journalist for Readers Digest describes this situation well in his article, "On the Trail of a Scam" He describes a savings and loan scam and the man behind it all. "Meyer learned that New Era was run by John G. Bennet, Jr., a 57 year old evangelical Christian." (112) New Era was a getting money from a private university, in which he promised huge returns on their investment. New Era did show them huge profits, but only to gain their trust and invest more money. The private university was gaining trust in New Era and investing more money. Finally, when They had invested a large sum of money, New Era collapsed and John Bennet walked away with the university's money. Mr. Bennet is a prime example of our findings. He is a man over the age of eighteen and he is in a position of power. People have entrusted him with their money. To commit his crime, he needed to be in a position where he was trusted, or in authority. After he won their trust, he took their money. White collar crimes are growing at an alarming rate and must be curbed. There are many things that the nation can do to slow the growth of these crimes. The white collar crime that affects the most people is the scam. For that reason, scam prevention will be emphasized more than embezzlement. I feel that the most effective weapon against these crimes is to
In this day and age, a corporation, family, or individual always has a potential risk of encountering fraud within their money supply. On average, fraud and abuse costs U.S. organizations more than $400 billion annually (Federal Bureau Investigation, 2010). Many may think that white collared crime is only money laundering or stealing, but that is only two out of the sum that countless culprits get away with. The term “white-collar crime,” originally coined in 1939 is synonymous with the full range of frauds committed by business and government professionals (Federal Bureau Investigation, 2010). These frauds include anything from bankruptcy fraud, money laundering, identity theft, corporate fraud to a wide number of threats all circling
For misconduct, crime, and criminalization in particular as it relates to white collar crime, there are the three main issues that must be addressed to show valid theory. The first is criminality. The criminality of white collar crime is the focus on an individual or organization’s motivation the situation that stimuluses and leads to the act of a white collar crimes. The theory is imparts the reason that makes a person commit a white collar crime. The second issue white collar crime theory must address is the explanation of a crime. In the case of white collar crime the situational factors play a much bigger role and most situations are not the same. When it comes down to this level of analyzing a white collar crime. Some of the factors
I really enjoyed your discussion Chadrick. In today’s society, crime exist in many areas. There are a lot of theories on how the behavior of these crimes should be handled. My philosophy is that the offenders should be punish to the degree of the predetermined executions of the law. I agree with you that all crimes should be handled differently and according to the nature of the crime. It saddens me on how white collar crimes are being treated when a trial goes to court. An example is the former chairman and chief executive of MCSi Michael E. Peppel was only given a seven-day prison sentence because the judge quoted that the defendant was “a remarkably good man” (The Challenge, 2013). Good men don’t plead guilty to conspiracy, money laundering,
White collar crime is immovably on the rise, thanks to our technologically advancing society. Forgery and counterfeit is another growing form of white collar crime. These acts are defined as imitating or counterfeiting documents or signature for the cause of lying to someone. From the year 1984 to 1993 Forgery and counterfeit increased twenty-one percent and it is still growing (U.S. Dep. Of Justice 240). The growth in white collar crime incidents has also contributed to a rise in cost to the nation. According to National Fraud Center statistics, the cost of economic crime has grown from five billion in 1970 to one-hundred billion in 1990, and is only expected to increase as circumstances become more frequent. I believe in the future white collar crimes will go and violent crimes will decrease. The National White Collar Crime Center (NW3C), a nonprofit agency that supports state and local police in their efforts to stop, investigate and prosecute economic and high technological crime, reports that while arrests for violent crimes have decreased in recent years, arrests for white collar
White collar crime is a serious issue in the United States. White-collar crime is “a crime committed by a person of respectability and high social status in the course of his occupation” (cornell.edu). Examples of such offenses include bribery, credit card fraud, insurance fraud, bank fraud, blackmail, extortion, forgery, securities fraud, tax evasion, embezzlement, repair scams, Ponzi and pyramid schemes. These non-violent crimes are responsible for an estimated $250 billion to $1 trillion in economic damages each year (Martinez). Individuals who commit white collar crimes have an increased likelihood to experience injustice compared to those who commit a street crime as noted in multiple studies detailed in various scholarly articles. Also, street criminals have a greater chance of getting caught in their wrongdoings versus white-collar criminals. Those who commit white collar crime make their decisions based on the philosophy or idea that their actions have low risk and a high reward. We face a dilemma in the United States because white-collar criminals are treated with minimal, inequitable punishment due to their social status, whereas the street criminals are treated with the correct, impartial punishment.
There has been numerous white collar crimes in the El Paso, Texas area, some of the most publicized cases involve a former El Paso Independent School Superintendent, a former Ysleta Independent School Superintendent, a former El Paso County Commissioner, a former El Paso County Park Manager, the New Mexico Security of State, the Dona Ana County Clerk and a recording and licensing lead, and two document technician also from Dona Ana county, a former Socorro City Councilman, several former United States Border Patrol Agents, and a former Fort Bliss Commander. Charges has been filed in all these cases some are still making their way through the justice system. We will examines Lorenzo Garcia the former El Paso Independent School District
White Collar Crimes and Drug Crimes both causes a big problem with our society. White Collar Crimes according to the film “The Business of White Collar Crime” as a crime committed by a person with respectability and a high social status in accordance to his occupation. While a drug crime is a crime where you have possession of drug paraphernalia or if you are manufacturing drugs. Another way to be charged with a drug crime is if you are trafficking and distributing drugs. Drug crimes can be done on a state and federal level. While white collar crimes is almost always tried on a federal level. A federal crime or federal offense is a violation of a crime that was made illegal by the United States federal government. If you violate a federal law you would be sent to a federal prison instead of a state prison.
White collar crime has been present for many years. It may have been over looked, but it still was present even in the twentieth century. White collar crime can be defined as nonviolent, illegal activities that principally involve traditional notions of deceit, deception, concealment, manipulation, breach of trust, subterfuge or illegal circumvention. White collar crime is a broad category containing many different types of offenses. Even things such as music piracy seem to fit this definition. Small crimes such as music piracy or illegal prescription drug buying is not really enforced much because these are not really major crimes. The criminal in this crime is probably an elderly individual or child. Most prosecutions of white collar
