Federalism And The Other Federalism

When problems arise in our nation, we are left with a complicated crisis as to whose job it is to do what and who exactly should be taking care of any bad situation that seems to pop up with daily life anywhere in the world, but in this case, America. Certain governmental systems, such as Federalism, can be considered a solution to these crises. Federalism can be defined as the relationship between the individual state governments of America and the national or federal government of the United States; and works to balance the power of a large central government, and the power of the smaller regional governments.

To define the terminology of federalism to a simplistic way is the sharing of sovereignty between the national government and the local government. It is often described as the dual sovereignty of governments between the national and the local to exert power in the political system. In the US it is often been justified as one of the first to introduce federalism by the ‘founding fathers’ which were developed in order to escape from the overpowered central government. However, federalism in the United States is hitherto uncertain where the power lies in the contemporary political system. Federalism was the first guard against tyranny. The central government and states both had their own powers but also shared a few. They had trading, conducting foreign relations, declaring war, making immigration laws etc. Local state governments got elections, establishing schools, passing marriage and divorce laws, and regulating in-state business. “The different governments will control each other and at the same time it will be controlled by itself,” said James Madison in the federalist paper #51.

Federalism guards against tyranny by dividing the power between central and state governments. Some powers given to the central government are to regulate trade, to declare war, and etc. Powers given to the state government are to hold elections, establish schools, and etc. Both the state and central governments check each other to make sure one doesn’t get too much power.

For AP United States history I chose the federalist and anti federalist compare and contrast that impacted America to the first party system because the past actions have affected us in the present. We analyze the past to find the foundations of present day political problems. I relate this to the SLO by committing time to community to present the past to the community they can understand how our country was developed and where the problems came from. I can urge them to understand why seeing the past is important to relate to the present. Federalism can be said to be the defining feature of all forms of American politics. Even as a literary characteristic feature, America was the first nation to adopt federalism as a concept. Federalism is a system of government whereby political power is divided between a national government and other smaller political constituents such as states. Federalism, although not mentioned exactly in the constitution, was supposed to be a concept that addressed the errors of the confederation (Platt, 2014). It was also supposed to be the lay the groundwork for what would be the future of America. Federalism is power divided between central and state government. The state governments can establish schools. The central government can declare war. The state government powers are local and the central government have nationwide powers (Federalism venn diagram). It provides double security by giving both the government and states the same/equal important power, Federalism guards against tyranny because it ensures that two levels share, one can’t accumulate.

The Anti-Federalist put up a long and hard fight, however, they were not as organized as the Federalists. While the Anti- Federalist had great concerns about the Constitution and National government, the Federalist had good responses to combat these concerns. The Federalist were and for the Constitution and feel the Article of Confederation were not worth ratifying, these should be scrapped altogether. They felt that the Articles limited the power of congress, because congress had to request cooperation from the states. Unlike the Anti-Federalist, the Federalist organized quickly, had ratifying conventions, and wrote the Federalist papers to rebut the Anti- Federalist arguments.

Federalism is a way of organizing a nation so that two or more levels of government have formal authority over the same area and people, ensuring that one does not become too powerful and aids in the separation of powers. Liberty is a state of freedom within a society from oppressive restrictions imposed by authority on one 's way of life, behavior, or political views. Although these two political science terms are different, they correlate and interact with one another in the American Government and are still relevant to contemporary policy issues faced today. James Madison 's The Federalist No. 47 doctrine exemplifies this: "In order to form correct ideas on this important subject, it will be proper to investigate the sense in which the preservation of liberty requires that the three great departments of power should be separate and distinct."

The Federalist and Anti-Federalist papers were created in response to the United States Constitution. In 1787, the Second Continental Congress called for a federal convention. This meeting in Philadelphia came to create the U.S Constitution. It originally was held to revise the Articles of Confederation, but due to the mindsets of many proponents present at the convention, like Alexander Hamilton and James Madison, and the vision of creating a new government rather than fixing the old one, the United States Constitution was formed. Once this was sent to congress it was submitted to the states for ratification. In response, many articles and letters were submitted to the public criticizing the proposition. These articles and letters are where the Anti-Federalist papers are derived from. Although there was opposition to the Constitution, many were in its favor. In response to these criticizing papers, Alexander Hamilton, John Jay, and James Madison wrote papers in the constitutions defense. These were come to be known as the Federalist papers. Two papers in particular, Federalist 51 and Anti--Federalist 51, are written on the topic of checks and balances and how this relates to a separation of powers within the national government. These arguments were successful due to their primary points of contention and strong arguments proposed.

Federalism is the term that defines the relationship of Federal government and state. Federalism is the essential relationship between state and the federal government’s .The textbook, Politics in America gives a similar definition. “A constitutional arrangement whereby power is divided between national and subnational governments” (Dye 98) .The federal and state government’s divide the powers given to them by the Constitution, so that they can’t gain control of each other, and so one doesn’t become more superior than the other one. Certain documents state the relationship they have and what makes them distinct.

In America today there are many political parties which include the Democrats and the Republicans. The beginning of political parties started in 1787 with the federalist, then later on the anti-federalist in 1796. Alexander Hamilton was the leader of the federalist party. Thomas Jefferson was the leader of the anti-federalist; who called themselves the Democratic-Republicans. Our first president, George Washington warned us about having parties and the danger of them. However, "not until Congress debated the ratification and implementation of Jay’s Treaty with Great Britain did two political parties clearly emerge"; the Federalist and the Anti-Federalist. Today the most influential parties are the Democrats and the Republicans. These parties win all of the presidential elections as of today. Political parties formed because the United States was beginning to grow and expand. Many people had different opinions and so political parties were formed. People were concerned about the how the new government was going to be organized.

Federalism involves the sharing of powers between different levels of government. In the United States this relates to the government at national level (the federal government) and those at the level of the state. The United Kingdom is not a federal state instead it is a unitary state where power is held in one place (parliament).
