Federal Government And Federalism

The government of the United States of America is a federal constitutional republic. In layman 's terms, this means that the country 's national, central government and the smaller, unitary governments of the fifty states are co-equal in their power, and that the citizens of America have a say in public policies by electing representatives who voice their respective opinions. More importantly, both the central government and the state governments are subject to the supreme law of the Constitution. Under this document, the central government is set up into three branches (the legislative, executive, and judicial) that are meant to check each other and balance out power. Their cooperation insures that the national government 's control is appropriate, and does not infringe upon the rights of the average American citizen.

The United States government system is for the security and happiness of the people and for the union of this country. The government keeps us safe, and it keeps us free. There are three branches of government: Judicial branch, the legislative branch, and the executive branch. The Supreme Court is head over the judicial branch, Congress is the head of the legislative branch, and the President is the head over the executive branch. Congress makes the laws, the Supreme Court interprets the law and the President enforces the law (house.gov)

The relationship between States and their localities in many cases is strained. State government gives their local governments life, they create the laws for them. However, throughout history, state governments have not treated their localities as they suppose to. That is why the National Conference of State Legislatures (NCSL) stated on the state-local relation “Legislators should place a higher priority on state-local issues than has been done in the past. The time has come to change their attitude toward local governments.” They want the state governments to see localities as partners in the federal system.

The United States government was created with three equal branches in order to prevent tyranny. Each of branch have separate duties. Congress, the legislative, makes the laws. President, the executive, enforce the laws. The judicial interprets the laws. Each branch has its own responsibilities and powers. The separation of powers is to prevent abuse of power and to protect freedom for all. With Checks and Balance, three branches of government can limit the powers of each others. It’s a plan to not let any part of government become too strong. A system of checks and balances prevents one branch from gaining too much power. All three branches has to be equal, so the American government can work. Under Federalism, the power is divided between state and national government. The state and government each have their own power and their shared ones. Both levels pass laws that affect citizens and both have officials and agencies. After Shay’s Rebellion and the nation on the brink of bankruptcy it was clear that the Articles of Confederation would not be sufficient. So began the great battle for the balance between order and freedom. The main point of dispute between the Federalists and the Anti-Federalists in their debates over the ratification of the Constitution surrounded the question of what powers were necessary in order to insure the security of the nation. The Federalists believed that a strong central government was needed, for reasons of national security and economic prosperity. However the Anti-Federalists were determined on retaining the sovereignty of the states and, in turn, their secured political freedom.

Federalism is our country's system of government, in this system powers are divided between the national government and the states, they also share some powers together. Federalism helps the nation work properly to where the power is divided pretty equally. This system includes powers that belong to the National Government, State Governments, and Shared Powers, which are powers shared by both the National Government and State Governments.

The United States Federal system of government has 3 branches that each have different functions when it comes to governing the people within the country. The Legislative, Judicial and Executive branches of government are all powerful, just at different times and in different situations. Checks and Balances were created and implemented so that each branch cannot have too much power.

The United States government is made up of representatives from several braches. The structure of the U.S government was created to divide the power of each branch equally to ensure that no one branch would overrule the expectations of the other branches. The government of the United States is represented by the Executive branch lead by the President, Congress, and the Federal Court system. The President has the ability to influence the population through his actions, Congress can create new policies that may benefit the people under the supervision of the President, and the Federal Court System can determine the laws or actions of each branch and decide whether they are unconstitutional. The three branches of government have some similarities and difference in how they operate their organization, however I believe that the federal court is the most important branch because interprets whether the president and congress are acting accordingly to the constitution.

The three government branches separate the power so it is not a concentrated government. There is a legislative branch, an executive ranch and the judicial branch. The legislative branch is also known as the Congress. Congress is in charge of making the laws for our country. Congress is made up of the House of Representatives with 435 members and the Senate with 100 members. The judicial system is made up of the judicial court full of supreme rulers and judges. They are in charge of interpreting the laws and determining how they are applied today according to the Constitution. Lastly, the executive branch is composed of the President and the Vise President. The president not only runs the country and plays an important role in making laws, he is also in charge of enforcing the laws that are created and passed through the other two branches. He also chooses experts to lead as his cabinet or advisors. The laws that are created must go through a series of “checks and balances” (Midkiff, personal communication, July 2, 2011) to be approved for release. This is the system that keeps laws from being passed without proper review. (This information is strictly from the notes given in class.)

Under the Articles of Confederation, Congress did not have enough power over the states. Things were not well thought out, it was a big mess. Luckily, the United States Constitution came to the rescue and replaced the Articles of Confederation. The Constitution divided power equally among the National and State government. The Federal government was divided into three branches: Legislature, Executive, and Judicial. The Legislature branch is made up of the House of Representatives and the Senate. Both have incredible power. They are the ones that create the laws. The House of Representatives can raise taxes, put officials on trial, elect the President in case of a tie. While the Senate decides on impeachment, approve treaties, court appointments. The Executive branch is the President and his team. They set up the budget, enforce laws, set foreign policy, veto bills. The Judicial branch is the Supreme Court. It is above any other court in the United States. Not all court cases make it to the
