Ani Chopourian claimed she had been tormented and sexually harassed by surgeons and the medical staff in the Cardiac Surgery Center at Mercy General Hospital between the years of 2006 - 2008. She stated that doctors used inappropriate sexual dialogue and acted in a passive aggressive behavior. Ms. Chopourian filed approximately 18 written complaints regarding patient safety, sexual harassment, as well as meal and break rules not being in compliance with policy. Her last filed complaint was received by human resources July 31, 2008 and consequently, she was terminated on Aug. 7, 2008. The hospital and HR claimed that she reportedly fell asleep on the job and failed to show up for her on-call shifts (Francis, 2012). Ms. Chopourian followed the correct steps stating her claim and won the law suit because ultimately HR is responsible for guaranteeing that employees comprehend what sexual harassment is, the laws, and the company guidelines as well as their compliance to these laws. HR has the responsibility to conduct training seminars, provide brochures, and one-one-one coaching sessions with all employees. It is important to keep in mind that employees often fear losing their job or being reprimanded for filing a sexual harassment claim.
