Macro-level or societal theories include Marxist conflict theory, Robert Merton’s strain theory, and Feminist theory (Howitt, 2012). Positivist criminology emerged in the nineteenth century after people stopped relying on pure thought and reason and started to observe and analyze to understand the way things worked. “Positive philosophy was an explicit repudiation or reaction to the critical and ‘negative’ philosophy of the Enlightenment [Classicalist] thinkers” (Bohm 21). Positivism has two main elements: One “is the belief that human behavior is a function of forces beyond a person’s control [and] the second aspect of positivism is embracing the scientific method to solve problems” (Siegel 7-8). . Criminology is the scientific study of the nature, extent, cause, and control of criminal behavior (Siegel 4). Criminology is not just understanding criminal actions but also studying how to correct and prevent crime, overall. There are five major Criminological theories, (1) Classical Theory, (2) Positivist Theory, (3) Marxist / Conflict Theory, (4) Sociological Theory, and (5) Multifactor / Integrated Theory.

The Conflict model, sometimes called the “system conflict theory” or non-system perspective, provides another approach to the study of Criminology and Criminal Justice. The studies of this model, focuses on the social inequalities of different groups. Criminologists believe that society and social order are based on the powerful and dominant groups. This model argues that all of the social components are designed to serve their own interests and that justice is a product of conflict, rather than cooperation. Meaning that the criminal justice system is expected to compete between each other in order to make justice in society, and that this is the most accurate way to deal with crime.

Criminology is the definition of our crime today, it defines many aspects and elements that challenge our common sense understanding of crime. The term ‘Criminology’ was first introduced into the English language in Garland 1988 by a criminologist Havelock Ellis (jones, 2013, pp. 2-3). However criminology was present in the 1860’s as Henry Maudsley a medic that worked in the prison systems to study insane and feeble - minded criminals (jones, 2013, pp. 2.) The reasoning of crime has changed considerably over the past 40 years, some say it was the change of the criminal justice system abolishing Capital punishment in 1965, or just the development in different legislations. Making punishment more psychological rather than physical punishment may have increased the velocity of the crime rate today as some may argue it is less harsh. Orthodox criminology refers to the how criminologists accept the states ideas of crime without thinking of power relations. This thinking is shared by everyone and becomes a universal idea and these ideas are in the interests of everyone. However, certain groups of individuals are targeted and blamed for crimes based on their class, race, gender, sexuality and more. The theory of Critical criminology as defined in Primer in Radical Criminology is defined as “a way of doing criminology that frames the problem of crime in terms of the sociological forces of class, race, gender, culture, and history.”(1) In other words it focuses on challenging the state on their traditional, “normal” views of crime by looking at other factors. Three differences between critical and orthodox criminologists are the following. The first difference is that critical criminologists seek to find the root of what is behind the crime problem. (14) Rather than saying that the homicide was committed because he was an African American male who is poor (orthodox criminology), critical criminologists look at a deeper sociological explanation, like the community he grew up in has high rates for violence. Theories of criminology were developed centuries ago so people can go in depth to seek what cause crime and why. In some cases these theories can eve go to the extent to prevent the crimes from happening again. Over the years more theories have been developed and the theories that have already been developed have been added to so they fit a larger spectrum. What cause a person to commit a crime and why would they commit a certain crime over another? These theories that have been developed give us an insight to the answer of these questions. The way feminism relates to criminology shows it has had an impact, this has led to change as well as differences in opinion. Feminism was introduced as a way to focus on destroying the inequalities between men and women. According to the views and opinions on criminal or deviant behaviour in the 1970s is that the relations made lead to further information been discovered in the 1980s and 1990s. Also, different types of feminism were made known such as liberal, socialists, radical and bourgeois.

All feminist theorists share a common focus on gender inequality; however feminism can be described as a set of perspectives rather than a single viewpoint (Strider, N.d.). Therefore, challenging gender biasness in the criminal justice system from the feminist perspective can take many forms given the fact that there a lot of sources of gender inequality in the system. For example, the early theories of criminal behavior largely ignored gender all together and as a result the field has become largely male dominated and males have also been shown to commit more crimes than women on average.

Social conflict theory is the only one out of the vast number of criminology theories that deals directly with this problem. From out of it’s Marxist roots arose a theory which challenges the way in which today’s society views it’s legal system and the implications it has on it’s working class citizens. The nature and purpose of social conflict theories is to examine the social controls made by the ruling class and imposed on the rest of society.
