Articles Of Confederation And Federalism

The Articles of Confederation was first written in 1777. It was passed by the Confederation of Congress. Congress decided that they needed a firm government to organize the states as a whole. At least that was their primary goal. Since each state had separates rules. The Articles of Confederation was later ratified by each state in 1781. It was “America’s first federal constitution” (Keene 138). The confederation had a few strengths but many weaknesses. The nation faced many economic and political issues that lead people to controversy.

In the Unites States of America Federalism is the basic structure of the American government; it is the distribution and balance of powers between the National government and the States government. In order to obtain a compromise between those who wanted stronger state government and those who preferred a stronger national government the founding fathers arranged and settled for a federal system rather than the alternatives of a unitary or confederal system. While both National and State governments each have specific powers and authority, they also share certain powers and must be able to cooperate effectively with each other.

The most significant issues that the United States had under the Articles of Confederation were: “managing the western expansion, foreign relations, and debt.” The first significant issue was with the western expansion as Americans relocated to the Nashville, western Pennsylvania, and Kentucky areas in mass numbers in the 1780s. The result of this meant that the areas were enhanced greatly that had western charters. At the time, the northern and southern areas (in the Appalachian Mountains and Mississippi River) had specific boundaries based on the original colonized charters which meant that the western area was the Pacific Ocean. The states that did not have part of the western area resented the condition and as a result, Maryland protested by not approving the Articles of Confederation unless the state of Virginia yielded its western land to the federal government which they did in 1784. However, their yielding was not without strings attached as they demanded that they be allowed to keep a small portion of the land reserve for their own use as a part of the deal which Congress had no choice but to accept. Eighteen years later in 1802, every state had yielded their western land to the federal government.

It all started after the Declaration of Independence during the time America was busy fighting the Revolutionary War, when Congress realized that they needed to form a plan to move forward and unite the thirteen states as a nation.

Federalism guards against tyranny by dividing the power between central and state governments. Some powers given to the central government are to regulate trade, to declare war, and etc. Powers given to the state government are to hold elections, establish schools, and etc. Both the state and central governments check each other to make sure one doesn’t get too much power.

Rules would be the new topic of discussion at the end of the American Revolution amongst the newly formed Free states that won their independence from Britain. One huge question loomed over the Free states, how could they conduct a civilized way of living without another ruler such as the king of Britain here in America? There needed to be some sort of system that would generate a control to create a unified country. States were acting and conducting business as if each state was its own country and this left the America vulnerable on many fronts. Some of the main issues that surfaced were; How to divide powers between local and national governments? Which laws should be made, and by whom and who would enforce them? I will address some of the differences between the Constitution and The Articles of Confederation.

Federalism can be said to be the defining feature of all forms of American politics. Even as a literary characteristic feature, America was the first nation to adopt federalism as a concept. Federalism is a system of government whereby political power is divided between a national government and other smaller political constituents such as states. Federalism, although not mentioned exactly in the constitution, was supposed to be a concept that addressed the errors of the confederation (Platt, 2014). It was also supposed to be the lay the groundwork for what would be the future of America. As it was expected to be, federalism has had an impact on the American politics even as far as elections are concerned. There were some key reasons that

Federalism has played a large role in our government since the time that the Constitution was ratified. It originally gave the majority of the power to the states. As time went on, the national government gained more and more power. It used the "necessary and proper" clause of the Constitution to validate its acts, and the Supreme Court made decisions that strengthened the national government creating a more unified United States. Finally, the recent course of federalism has been to give powers back to the states.

The Articles of Confederation, which was considered the first constitution of the United States of America, and the US Constitution, which acts as the supreme law in the United States today, both are poles apart. In fact, it was only because of the weaknesses of the Articles that the present-day US Constitution was drafted. The Articles of Confederation or Articles was a written agreement which laid the guidelines for the functioning of the national government. It was drafted by the Continental Congress and sent to the thirteen original states for ratification in November 1777. Within a few years of its ratification, the Articles was subjected to severe criticism by the Founding Fathers of the United States. Problems with the document existed in plenty; the biggest issue being the fact that it left the national government at the mercy of states. Eventually, it was decided that this agreement had to be revised to suit the needs of the nation as a whole. The delegates at the Philadelphia Convention came to the conclusion that it was better to draft an entirely new constitution instead of revising the existing agreement, and thus came into existence the new US Constitution.

Federalism is the term that defines the relationship of Federal government and state. Federalism is the essential relationship between state and the federal government’s .The textbook, Politics in America gives a similar definition. “A constitutional arrangement whereby power is divided between national and subnational governments” (Dye 98) .The federal and state government’s divide the powers given to them by the Constitution, so that they can’t gain control of each other, and so one doesn’t become more superior than the other one. Certain documents state the relationship they have and what makes them distinct.

The Articles of Confederation was ratified on March 1, 1781. It limited Congress’s influence and power over the colonies, but allowed them to manage foreign relations or Indian affairs, coin money, maintain a postal service and as a last solution, intervene with any disputes between the states. After the Revolution, Americans wanted to avoid tyrannical or monarchy government, therefore letting each state rule over themselves would eliminate having to report to higher authorities, however this caused disorganization and no one or government to lead the states. The states believed in “a firm league of friendship”, never came true as each state would compete with other to increase their population, wealth and land. However, the most important fact about the Articles of Confederation is that it harmed America more than it help it as it kept the states separated. Without a plan, goal or a common purpose, the colonies fell apart, fighting for self glorification and improving themselves, instead of helping each other. Furthermore, the Articles of Confederation failed to address on the restoration of America, such as paying war debts and when “The Requisition of 1785”, was implemented, people protested by starting riots and states capitol printed more paper money than there was gold, thus liquidating the value of the dollar. This leads to an event that caused a turning point in the restoration of American during the 18th century, “Shays Rebellion”.

When the war finally came to an end in 1781, the economy was still suffering due to the lack of knowledge the states had on both economic and political matters. Since it was agreed upon that the nation wanted to be a democracy, the Constitution was shaped accordingly. The Articles of Confederation where written in order to establish a national government among the thirteen original colonies. There were many factors that caused of the crisis but the main reason was because of the Revolutionary war. The United States had taken on a substantial amount of debt in order for them to fund the war and the British Navy had targeted to destroy American ships, which led to a disruption in trade. The Articles of Confederation were the first attempt at a government system. This system was the cause of many conflicts between the colonies but eventually some of the ideas derived from it still helped form the constitution we abide by today.

The first video “The Constitution Project” – creating a constitution of the founding fathers creating and signing the constitution. This is a large piece of history which because of them, the constitution and the articles of confederation are what make makes America what it is today, unified. The major learning theme of this video is to understanding what and how these states came together, taxation, laws, and the people behind it. George Washington, Thomas Jefferson, and James Madison to name a few are the unique founding fathers who helped make America the way it is for years to come. Because of the constitution, constitutional conflicts have become a major focus and resolving them is another. Most of all, it’s significant to see the founding fathers go through conflicts of the constitution and eventually come to a compromise that are doable still today. It’s extraordinary to see first-hand of a group of leaders eventually reach a compromise about its core values, the government, states, and people’s rights.

Federalism is the division of powers between state and national governments. Federalism gave lower levels of government power that they did not have. The purpose of federalism is to give the people a sense of power, and essentially more liberty. However, it also allows a balance of power by giving states the rights to make their own laws, all while still recognizing the national government as superior.
