Stephen can start by acknowledging that an error was made in terminating Belinda’s position, and should contact the human resources office immediately to rectify the situation. The rationale that justifies this answer is the state and federal laws regarding the employment, termination, and sick leave. The Family and Medical Leave Act (FMLA) that was established in 1993 protect employees from wrongful termination; it establishes the right of employees to strike a balance between their work life and their personal life. The FMLA allows employees to get unpaid time off from work to take care of their sick family members, and take a leave of absence in the event of a serious medical condition. Additionally, according to the FMLA, employers are required to reinstate the employee to his or her original position or equivalent upon the completion of the leave of absence (US Department of Labor, n.d).
A growing number of states in the United State required a paid leave in addition to the federal regulations; states legislation requires employees to maintain their employment within certain time frame employment in order to accrue the sick leave hours. Additionally, the state’s regulation mandates that employees will not face any retaliation based on their medical condition
The problem solving methods that might be helpful to assist Jerry in making an ethical decision would be to establish trust with the patient and become aware of the problem. Then analyze the problems and decide on a plan with the patient. He will then want to make sure he reinforces the commitment to the patient and activate the plan. Last, he will follow through with the task and monitor everything until the situation is taken care of.
Superior’s current policy of seven vacation days and five sick days a year for the employees is not ideal for emergencies and for an unscheduled occurrence that may require the employee to take a day off. The policy, as written right now, does not give Joan Jackson enough time to properly staff the areas when an employee calls the morning of shift and states he/ she cannot make it to work today. Right now, employees are using sick days to whatever his/ her need is that day, which is more than likely not in regards to the employee being sick. It offers lowering cost as well as gets more access to high quality of care. This law creates Patient’s Bill of Rights that is very effective to protect consumers from any abuses or fraud from insurance company. Some preventive services are available to many Americans especially Medicare recipients at no cost. The individual’s health is a stock variable which changes over time. Hence, health decisions in one period not only impact that period but also impact subsequent periods. With paid sick leave, it is easier for an individual can take time off work to recuperate. This has multiple benefits. Firstly, it allows the individual to recuperate before health levels become extremely low. Extremely low levels of health will result in more ER visits and a longer recovery period. Secondly, if the individual has an infectious disease then paid sick leave allows the individual to recover and it prevents the infection from spreading to other people in the organization. Lastly, the improved health (due to recuperation) will increase employee productivity in subsequent periods at work. Hence paid sick leave will reduce ER visits over the course of the individual’s life.
You get the phone call in the middle of the night. Your son or daughter has been in a serious accident and is hospitalized in critical condition. After several day’s they come home from the hospital with several broken bones and require your around the clock attention for the next eight to twelve weeks. You just got over a serious medical condition yourself which you acquired while on vacation and do not have any vacation time or sick time to take off. Do you have to quit your job? Can your employer terminate you for taking time off to be with your child? What options do you have? What can your employer do for you? Well, the answer lies in the Family and Medical Leave Act.
As a Healthcare administrator there are many different challenges to be faced. Being the backbone of any company in general is a hard but rewarding task. On a day-to-day basis healthcare administrators have to deal with the bulk of the problems wherever they work. There are many ethical issues in the healthcare field. These issues range from insurance coverage, senior care, childhood immunizations, beneficence, abortion, medicinal marijuana, honesty and medical research (Fritzsche, D., 2004). Today we will discuss the ethical concerns in only one aspect of heath care and that topic is research (Benatar, S., 2000). Medical research is necessary in order to make strides in health care, introduce new medications, to discover new symptoms and disorders and to test new treatment options for current medical problems. Students of medicine, universities and pharmaceutical companies conduct this research primarily. Much of this research is time consuming and costly, therefore obtaining funding is not
The purpose of the paper is to answer all four case studies and to provide rational for my discussions.
Nurses are faced with ethical issues and dilemmas on a regular basis. Nurses must understand his or her values and morals to be able to deal adequately with the ethical issues he or she is faced with. Some ethical issues nurses are exposed to may be more difficult than others and the ethical decision making process is learned over time.
Having an effective ethics and compliance in health care training course for employees within a company is a positive effort to keep not only the company running strong and efficient, but also developing standards for other companies to follow who are trying to create a more applicable format for corporate regulations. According to federal guidelines, designated and regulated by the Office of Inspector General (OIG), a company in compliance to federal healthcare standards will have effective education of employees, investigation measures, discipline and enforcement measures, intervention of violation standards, strong internal audit standards, compliance officers and staff, and lastly, written company standards and policies that is freely available to all employees.
Before a health care organization implements an EMR system, they should have a security system in place, which includes “access control” component. Access control within an EMR system is controlled by distinct user roles and access levels, the enforcement of strong login passwords, severe user verification/authorization and user inactivity locks. Health care of professionals regardless of their level, each have specific permissions for accessing data. Even though the organization have the right security system in place to prevent unauthorized users from access patient records, autonomous patients will expect to have access to his or her records with ease. Access their record will ensure that their information is correct and safe.
Ethical Codes are in use today by many organizations to clearly establish their values and provide a procedure if a code violation occurs. Medical ethics began as a professional code for physicians and has now expanded and includes a variety of health care professions and health care organizations. The growth of medical knowledge and technology have grown so have the concerns that ethical standards and issues facing our society today may be compromised or not appropriately addressed (Littleton et al., 2010).
