2 AEM2 Task 2: IEP Violation A. Legal Violation of an Individualized Education Program Mr. Williams, the advanced algebra teacher in the scenario, violated the student’s IEP by not following the accommodations listed in the document. An IEP is a formal document that outlines how an identified student with a disability will be provided a free appropriate and public education in the least restrictive environment. These are rights provided to children through the Individuals with Disabilities Education Act (IDEA). “The Individuals with Disabilities Education Act is a law that makes available a free appropriate public education to eligible children with disabilities throughout the nation and ensures special education and related services to those children” (“About IDEA”, 2023). According to McCarthy (2018), “Courts have clarified that an ‘appropriate’ education need not be ‘the best’ available or represent ‘optimum’ programs that will maximize learning potential.” (McCarthy, 2018, p. 167). Mr. Williams’ actions prevented Sara Thomas from accessing her maximum learning potential. He assumed that placing her with a small group was the best available option, however, he did not consult with her nor the IEP team regarding changes to accommodation. He also did not keep in mind the legality of Sara’s IEP, which strictly designates her testing to be accommodated in a one-to-one environment. Sara’s IEP was reasonably calculated to enable the child to receive educational benefits, however, the advanced algebra teacher’s actions of disregarding her IEP accommodations prevented her from this, as evidenced by her failing the exam and course for the semester. Additionally, any changes made to the student’s learning environment, specifically concerning the IEP, must be first discussed with the IEP team, and the parents consulted (Giuliani, 2012). Mr. Williams simply ignored Sara’s IEP accommodation of testing in a one-on- one environment, and because of this, her academic performance was jeopardized.

Synopsis of Incident As the Principal of George Madison High School (GMHS), I also serve as the local education agency (LEA) representative, which means I am a consistent member of the IEP team for the students within GMHS. On January 9th I received a letter from Mr. and Mrs. Thomas, the parents of senior Sara Thomas, regarding a formal complaint regarding an IEP violation. The letter read that Sara was not provided her IEP accommodation of taking assessments in a one-on- one environment, and therefore failed her exam due to a manifestation of her disorder and distractions because she tested in a small group which is a change in her normal setting. I thought back to January 5th, exam day, and remembered that Ms. Finkle had to call in sick that day because of a family emergency. I secured a substitute for Ms. Finkle who was given instructions to perform Ms. Finkle’s regular duties for that day. I couldn’t understand why Sara was not provided her testing accommodation as I was sure there was an adult there to assist with monitoring the one-on-one environment. As I continued reading the letter from Mr. and Mrs. Thomas, I noticed that they requested a meeting to discuss the violation as well as what could be done for Sara’s grade in Algebra. I had an investigation to conduct regarding this incident and needed to speak with Mr. Williams to understand what happened. B2 & B3. Investigation, Findings, and Stakeholder Conversations I began the investigation, after receiving the parent complaint letter, by first speaking with Mr. Williams. He explained his perspective in that he was thinking about Sara’s comfortability and was not comfortable sending her to test with a substitute when he felt she might feel more comfortable testing with an adult she is used to working with and in a room with students that Sara knows well. Mr. Williams stated that he did not check with Sara to see if this is something she would have been comfortable with, nor did he address this change with her
