Over 32% of all malpractice lawsuits against nurse practitioners are attributed to the most common malpractice charge, which is failure to diagnose (Nurses Service Organization [NSO], 2023). Esteban found no differential diagnoses, even though differential diagnosis entails compiling a list of suspected illnesses to direct medical professionals in their search for possible illnesses. Esteban disregarded Mr. Shien’s initial complaint about his leg and utilized the gout history to make a clinical decision. A patient must be informed about the potential risks, advantages, and available options before giving their consent for a particular diagnostic order, treatment, or intervention. Patient safety is at risk when pathology and medical imaging test are not discussed (Georgiou et al., 2023). Patient communication is key in medical decision-making.
